GUCCI GIFT CARD

The Gift Card is issued by GG Luxury Retail South Africa Proprietary Limited (hereinafter "Gucci"), a company incorporated and existing under the laws of the Republic of South Africa, with registered office in Shop U15 Diamond Walk, Sandton City, Johannesburg.

The Gift Card can be used only in South Africa and in the “Gucci boutiques” of:

Cape Town – Victoria Wharf Shopping Center

Johannesburg – Sandton City

Durban

Only Gift Cards issued in the Gucci Boutiques are subject to these General Conditions of Use.

The Gift Card is not assigned to a specific person and can be used by anyone presenting it in Gucci Boutiques. The bearer of the Gift Card shall be deemed to be the bona fide owner of such Gift Card.

The Gift Card is valid for 36 (thirty-six) months (end of month) from the date of purchase in accordance with the applicable provisions of the Consumer Protection Act No. 68 of 2008 and shall expire either (i) on the date upon which its full value has been redeemed in exchange for goods or (ii) at the end of the 36 (thirty-six) month period, whichever is earlier.

The Gift Card will be closed on the Expiry Date and any value remaining on the Gift Card will not be refunded to the customer. Should the customer, within a reasonable period, but no later than 30 (thirty) days before the Expiry Date, make a request at a Gucci Boutique to extend the time period after the Expiry Date, Gucci may, in its sole discretion, extend the validity of the Gift Card to the customer for an additional period, for the remaining value, subject to these General Conditions of Use. The credit on the Gift Card cannot be converted nor redeemed into cash or credit, nor can it be credited to a credit card or bank account. The Gift Card cannot be used to buy another Gift Card.

The Gift Card can be used once or more for the purchase of any product for sale in Gucci Boutiques. The price of the products purchased using the Gift Card will be deducted from the initial credit from time to time, until it is exhausted. More than one Gift Card may be used for the same purchase. If the Gift Card credit is insufficient to purchase the desired product(s), the missing amount shall be paid with other means of payment accepted by Gucci Boutiques.

Transactions (i.e. the purchase in cash of Gift Cards and/or the use of one or more Gift Cards for a single purchase) cannot exceed the limit set by Gucci’s Group Compliance, which is currently €50,000 (or equivalent in local currency) and may be subject to change over time. In accordance with the Financial Intelligence Centre Act 38 of 2001 (“FICA”) requirements, Gucci and/or or its agents shall be entitled to request a purchaser and/or bearer of a Gift Card to provide adequate proof of identity. Neither Gucci nor its agents shall be obliged to issue any Gift Card and/or approve any use thereof without satisfactory proof of the purchaser’s identity, which proof may include: (i) name and contact details (ii) an identity document, (iii) a driver’s license, and/or (iv) a foreign passport.

Gucci is not liable in case of loss, theft, damage or destruction of the Gift Card or unauthorized use of the Gift Card. If damaged, lost or stolen, the Gift Card cannot be replaced by Gucci with another of equal value. Gucci is not responsible for any loss arising from any failure, malfunction of electronic facilities or delay in point-of-sale device or our supporting or shared networks, where applicable, resulting from circumstances beyond our reasonable control. No warranties, purchase protection, insurance, other promises or services are provided.

Gucci reserves the right to reject any altered, damaged or illegible Gift Card without any refund to the customer. You will not be sent any correspondence or statements in respect of the monies used or balance remaining on the Gift Card.

These General Conditions of Use will, in all respects, be governed by and construed under the laws of South Africa and all disputes, actions and other matters relating thereto will be determined in accordance with such law. Gucci reserves the right to amend these General Terms of Use without notice to the customer. It is the responsibility of the customer to ensure that it is aware of the current applicable General Terms of Use.
