3.1 You acknowledge and agree that any proposals, projects, ideas, concepts, photographs, contributions or any other content and material (with the exception of personal information) disclosed or sent to Gucci through this Website or by other means (”Submitted Material”) is not considered confidential. By submitting the Submitted Material you grant to Gucci a royalty free, non-exclusive, worldwide right to copy, reproduce, publish, disclose, distribute or otherwise use, in whole or in part, the Submitted Material, for the entire term of protection thereof, for advertising, promotional or product development purposes.

3.2 Gucci is not required or will not be required in the future to:

(i) keep any Submitted Material confidential;

1. GENERAL PROVISIONS

These Rules for Distance Selling of Products (hereinafter, the "Selling Rules") regulate the business of GUCCI RUS Limited Liability Company, registered address: 16 Petrovka Str., Moscow, 127051, Russia; INN (Taxpayer Identification Number) 7708790060, KPP (Tax Registration Reason Code) 770701001, OGRN (Primary State Registration Number) 1137746449280 (hereinafter, "Gucci"), related with the distance selling of Products on the Phone.

By placing an Order and/or paying for a Product hereunder, the Buyer acknowledges and agrees to these Selling Rules.

Information on Products available on the Website and given on the Phone and by email constitutes an invitation by Gucci to make offers and does not constitute a public offer as defined in Part 2, Article 437 of the Civil Code of the Russian Federation. The Buyer has been notified that Gucci carries out distance selling of products solely within the Russian Federation, in accordance with the list of cities for which delivery is available. The up-to-date list of cities covered by the delivery may be checked at the Product Ordering stage. No delivery outside of the Russian Federation is carried out.

Gucci may at any time amend or supplement these Selling Rules at its sole discretion. The existing revision of the Selling Rules is available for review on the Website for the public at large.

The Website is owned by the companies of Gucci Group and is administered by them. The Selling Rules do not regulate provision of services or sale of products carried out by the third parties mentioned in the links, banners or other hyperlinks placed on the Website.

 

2. TERMS

  • "Order" means a duly executed Buyer's request made on the Phone to purchase one or several Products selected on the Website, and to deliver the Products at the address indicated by the Buyer.
  • "Buyer" means a legally capable individual that purchases or intends to purchase Products on the Phone for the purposes of using such solely for private, family, household and other needs not related with any business activities.
  • "Website" means https://www.gucci.com/int/ru/
  • "Party" means the Buyer or Gucci. "Parties" means collectively the Buyer and Gucci.
  • "Phone" means the telephone number of the Gucci client services: + 7 495 145 3182
  • "Product" means the products displayed by Gucci in the Website for distance selling in accordance with these Selling Rules.

 

3. INFORMATION ON PRODUCTS

  • Information on Products available to Order is given at Gucci's permanent stores, on the Website, and on the Phone. By accepting these Selling Rules, the Buyer confirms, that the Buyer has been informed that not all the Products placed on the Website may be available to Order.
  • The Products offered for sale in the Website may have some inaccuracies in terms of matching the real Products in view of perceiving their appearance, size and colour, subject to the browser or the display used.
  • The ability to Order a specific Product depends on its availability in stock.
  • The price of the Product shall be confirmed during Order execution. GUCCI cannot guarantee that at the time of the Buyer's applying with the Order the selected Product will be available.
  • The Buyer has been notified that no warranty period for the Products has been set, except as expressly provided otherwise.

 

4. PRODUCT ORDERING

  • These Selling Rules apply for executing an Order by reaching the Gucci client services on the Phone.
  • Purchasing the Product ordered over the Phone shall be made as a contract of adhesion, entered into subject to the conditions stated in the Selling Rules.
  • The Product is furnished to the Buyer based on the Product description proposed by Gucci on the Website, the information obtained over the Phone or by email from employees of Gucci, which excludes the Buyer's possibility to directly get acquainted with the Product or the Product sample.
  • The distance purchase of Products by the Buyers is regulated, inter alia, by the Civil Code of the Russian Federation, by Federal Law No. 2300-1 "On Consumer Rights Protection" dated 07.02.1992, by Resolution No. 55 of the Government of the Russian Federation, "On Approving the Rules for Sale of Separate Types of Products, the List of Durable Products to which no Buyer's Demand on Free Provision of a Similar Product for the Period of Repair or Replacement Applies, and the List of Non-Foods of Proper Quality that are Non-returnable or Non-Replaceable with a Similar Product of Other Sizes, Shapes, Dimensions, Style, Colouring or Contents" dated 19.01.1998, by Resolution No. 612 of the Government of the Russian Federation, "On Approving the Rules for Distance Selling of Products" dated 27.09.2007, by Federal Law No. 41-FZ "On Precious Metals and Precious Stones" dated 26.03.1998.
  • For the purpose of an Order execution request, the Parties agree over the Phone the name of the Product, its price, quantity, range, main consumer properties, conditions of the Product purchase and delivery. The Buyer gives to Gucci the following data over the Phone:
  • surname, name and middle name of the Buyer;
  • surname, name and middle name of the Product recipient, if to be received by a third party;
  • name, model, article number, material, colour, size of the Product;
  • delivery address;
  • contact phone number;
  • email of the Buyer.
    • Gucci is not responsible for the Buyer's submission of invalid information at the time of Order execution. Should any information indicated in clause 5 hereof be missing, the Order shall be deemed non-executed.
    • Having received from the Buyer an Order request, Gucci client services confirms availability of the Product, executes the final Order and sends to the email provided by the Buyer a letter that contains the executed Order to be confirmed as well as the links to the Website sections where the Buyer may read and understand the Selling Rules, the Personal Data Processing Policy and information on the Product. Apart from the letter described above the Buyer will also receive a link for non-cash payment sent in a separate e-mail sent through Gucci’s personal account at the bank providing payment services.

Having received such information, the Buyer checks the executed Order, including its total price, examines the final conditions for purchase of the Product, and, provided the Buyer's consent to all the conditions, confirms the Order by non-cash payment method indicated by Gucci.

  • Orders for jewellery items / items with precious metals and/or precious stones shall be executed separately from products of any other categories. Such products may only be delivered directly to the Buyer, in view of clause 18 hereof.
  • To execute an Order for jewellery items / items with precious metals and/or precious stones, the Buyer shall additionally send to Gucci a copy of his/her passport, and in case of foreign nationals and stateless persons also a copy of the migration card and/or the document verifying the right of a foreign national or a stateless person to stay in (reside) the Russian Federation, and other information requested by Gucci. In case of failure to submit the requested information, Gucci may decline execution of the Order.
  • When purchasing jewellery items / items with precious metals and/or precious stones, the Buyer must also inform Gucci that the Buyer is: a foreign public official, an official of public international organisations, a person that occupies public positions in the Russian Federation, position of a member of the Board of Directors of the Central Bank of the Russian Federation, positions with a federal public service which are appointed and vacated by the President of the Russian Federation or by the Government of the Russian Federation, positions with the Central Bank of the Russian Federation, state-owned corporations and other organisations established by the Russian Federation under the federal laws, included into the lists of positions determined by the President of the Russian Federation, or by their spouses, close relatives (lineal descendants and ancestors (parents and children, grandfathers, grandmothers, and grandchildren), full-blood and half-blood (having a common father or a mother) brothers and sisters, adoptive parents or adopted children) or by a person acting for the above persons.

In case the Buyer belongs to any of the above categories, Gucci may request the documents confirming the origin of the money used to purchase the jewellery items / items with precious metals and/or precious stones.

Where the Buyer refuses to submit the above documents or in case the Buyer is found to be belonging to any category of the above persons and the Buyer fails to submit the documents requested by Gucci, Gucci may refuse to sell jewellery items / items with precious metals and/or precious stones to the Buyer.

  • The Order shall be valid for 24 hours from the time of Gucci's sending a letter to the Buyer, save as otherwise provided for in the Order under which the Product is reserved in favour of the Buyer.
  • When the Order needs to be modified, the Buyer contacts the Gucci client services over the Phone, whereupon an updated Order is sent to the Buyer for confirmation.
  • Payment of the Order shall be deemed the Buyer's proper confirmation that the properties of the Product in the letter comply with the Order, the Buyer's consent with the conditions of purchasing the Product and these Selling Rules, and does not require an additional verification by Gucci.

 

5. PAYMENT FOR THE PRODUCT

  • The Buyer shall pay for the Product via a bank card at the electronic invoice issued in the payment page, by a method indicated in the letter which is sent to the Buyer as set forth in clause 7 hereof. No Products purchased under the Selling Rules may be paid with cash, or via payment terminals or using any alternative means of payment.
  • The moment of entry into the Products retail sales contract and its entry into force shall be considered as the moment of payment, evidenced by the sales receipt.
  • Payment of the Order on the bank details shall be made by the deadline indicated in the relevant letter to the Buyer. In case of payment after the deadline, Gucci does not guarantee availability of the Product or its price, which may lead to longer period of Order processing or the Order may be fully or partially cancelled by Gucci.
  • For the avoidance of unauthorised use of bank cards, the payment of Orders shall be verified by Gucci. Gucci reserves the right to cancel an Order with no explanation. The price of Order shall in that case be refunded to the owner's bank card.
  • A sales receipt shall be sent to the Buyer after payment. By making a payment via a bank card, the Buyer consents to being sent an electronic sales receipt (a link to the downloadable PDF sales receipt) to the email, or to the phone number indicated by the Buyer. In that case, printed sales receipt may not be provided.

 

6. PRODUCT DELIVERY

  • The Product shall be delivered by GUCCI, inter alia via an engaged express delivery service or a carrier (hereinafter, "Express Delivery Service").
  • Gucci shall be responsible for the Product delivery charges.
  • The Product shall only be released for delivery to the Buyer after the full price of the Product was received on Gucci's bank account.
  • Delivery is carried out on business days, from 9:00 until 18:00.
  • Other, including individual conditions of delivery, may be defined by Gucci and brought to notice of the Buyer by posting on the Website, over the Phone or by email.
  • The Product is generally delivered personally to the Buyer, at the address the Buyer indicated in the Order. A representative of Gucci or the Express Delivery Service will contact the Buyer to clarify the specific place and time of the Product delivery. The final date of receiving the Order by the Buyer depends on the address and region of delivery, operations of a specific Express Delivery Service, and do not directly depend on Gucci.
  • The risk of accidental loss of / damage to the Product passes to the Buyer from the time of handover of the relevant Product.
  • Along with handover of the Product, the representative of Gucci or of the Express Delivery Service hands over to the Buyer a copy of these Selling Rules, the Product care guide (if any), and other information that must be submitted under the applicable laws of the Russian Federation.
  • If the Buyer so willing, the Products may be delivered to a third party, except for the jewellery items / items with precious metals and/or precious stones, which exceed the values set forth in clause 18 hereof. The Buyer undertakes to inform Gucci about it at the time of Order. That third party shall be indicated in the Order as the recipient, with delivery to its address.
  • The Product delivery shall be made, given that the Buyer or the receiving third party provides the identity document.
  • The person that receives the Product may open the package and check its contents. No try-on or return of unsuitable Product to the delivering employee is available.
  • By signing the Order delivery documents provided by the Express Delivery Service, the Buyer confirms that the Product was accepted, the outer and inner packaging of the Product are not damaged, and the Product was in proper condition, and that the Buyer was given these Selling Rules with full information about the Product return procedure and deadline.
  • In case the Buyer refuses to sign the documents that confirm delivery of the Product or refuses to accept the Product, the Express Delivery Service representative unilaterally signs the documents and indicate the Buyer's refusal to sign/accept.
  • In case of a refusal to sign the documents that confirm delivery of the Product, the Parties acknowledge that the Buyer duly accepted the Product, and no defects were discovered in the Product.
  • If the Buyer discovers defects in the Product during its acceptance, the Buyer shall indicate that in the documents that confirm delivery of the Product.
  • In case of refusal to accept the Product, such Product is returned by the Buyer as set forth in clause 7
  • A confirmation is sent by email after the Order is delivered to the Buyer.
  • If an individual buys jewellery items from precious metals and precious stones for the amount exceeding RUB 40,000, and if a personalised electronic payment facility is used to purchase jewellery items from precious metals and precious stones for the amount exceeding RUB 200,000 pursuant to Clause 1.4-2, Article 7 of Federal Law No. 115-FZ "On Countering Legalisation (Laundering) the Proceeds of Crime and Financing of Terrorism" dated 07.08.2001, the Buyer must produce an identity document and information to be forwarded to Rosfinmonitoring (Federal Financial Monitoring Service) to the person who delivers the Order.
  • Opening individual packages of jewellery items from precious metals and precious stones shall be without damaging the integrity of labels, tags, and seals attached to the item, and items shall only be tried on in the presence of the person that delivered or issued the Order.

 

7. RETURN OF THE PRODUCT

  • The Buyer may reject the Product of proper quality at any time prior to its handover, and after the handover - within 7 calendar days, provided its preserved marketable appearance, consumer properties, seals, factory-made tags, and so on, and provided the Buyer has preserved the document confirming the occurrence and conditions of purchasing the Product. Should any traces of using the Product be detected, Gucci reserves the right to refuse refunding of money for this cause.
  • The Product of proper quality shall be delivered to Gucci prior to expiry of 7 calendar days from the date of its receipt by the Buyer to 16 Petrovka Str., Moscow, 127051, Russia, from 10:00 until 18:00.  
  • The Product return delivery slip or return certificate shall be executed if the Buyer returns the Product of proper quality.
  • The Buyer may not reject the Product of proper quality with specific personal properties, if the indicated Product may be used solely by the Buyer who purchases it.
  • The Product of improper quality may be rejected as and when stipulated by the laws of the Russian Federation.
  • Non-returnable and non-replaceable shall be the Products of certain categories, as stipulated in Resolution No. 55 of the Government of the Russian Federation dated 19.01.1998.
  • If purchasing a set of Products on a promotional basis, where a discount was offered for one of the Products or all Products in the set, the Products of proper quality may only be returned as part of the set. No return of separate Products from the set is possible, unless otherwise stipulated in the promo offer rules.
  • The amount paid by the Buyer shall be refunded not later than 10 (ten) calendar days from the date of producing the relevant claim by the Buyer. Deemed as the date of the Buyer's claim for refund for the Product shall be the date of Gucci's receiving the returned Product and confirming its marketable appearance and consumer properties, and in case of returning the Product of improper quality – the date of Gucci's receiving the Product, provided the confirmation of its improper quality is available.
  • The amount paid by the Buyer shall be refunded in the same method as used to pay for the Product. If paid via a bank card, refunding is made by transferring the paid amount to the bank card from which the Product was paid.
  • The Product shall be returned by the Express Delivery Service. If the Buyer is willing to reject the Product (whether of proper or improper quality), the return shall be made by applying to the Gucci client services by Phone. Based on the application received, Gucci completes the Product pick-up request, consents it with the Buyer over the phone and/or by email, and sends it to the Express Delivery service representative who agrees with the Buyer the date and other conditions of pick-up. Details will be agreed over the phone and by email.
  • If the Buyer is given the Product in breach of the conditions of contract related to the quantity, the range, the quality, contents, the tare and/or packaging of the product, the Buyer may not later than 20 (twenty) days upon having received the product notify Gucci about such breaches.
  • In case of the Product handover in violation of the range provision, the regulations from Article 468 of the Civil Code of the Russian Federation shall not apply. If a Product outside of the ordered range is discovered in the Order, the Buyer may, at the time of Order handover, reject such Product and demand replacement for the Product from the range indicated in the Order, or refunding of the money paid for the product that was not actually handed over.
  • The costs of returning the Product, both of proper and improper quality, shall be borne by Gucci.
  • The Product of proper and improper quality may only be returned, provided its initial purchase by applying to the client services over the Phone. A Product purchase at Gucci stores or otherwise cannot be returned in the manner described herein.

 

8. LIMITATION OF LIABILITY

  • The Buyer's data provided during Order execution are presumed to be authentic, belonging to the person who applied to the Gucci client services, and will be further used for communication and confirmation of the Order and delivery conditions. In case of changes in the email, phone number or other personal data during Order execution and delivery procedure, the Buyer shall promptly impart those into the client services over the Phone.
  • Gucci assumes no liability if sending electronic messages to the email indicated by the Buyer is impossible. In case of failure to receive the Order confirmation message from Gucci by email within 2 business days from the Order date, the Buyer shall reapply to the client services of Gucci to clarify the data. All the messages sent from the email indicated by the Buyer shall be deemed sent by the Buyer.
  • By accepting these Selling Rules, the Buyer confirms he or she has been notified and assumes the risks of adverse consequences related to giving access to his or her email to any third parties, and related to their giving of inauthentic contact details.
  • Gucci cannot guarantee that the Website and the Phone operate continuously, without connection errors to the Internet and communication networks. Gucci does not guarantee performance, relevance and entirety of the Website, absence of viruses therein. Gucci does not assume liability for any losses that may arise in using or impossibility of using the Website and the Phone, unless otherwise stipulated by the laws.

 

9. MISCELLANEOUS

  • No Orders over the Phone from legal entities and sole entrepreneurs shall be accepted hereunder. If discovered that the Order was executed by an individual in favour of a legal entity or a sole entrepreneur, such order shall be cancelled and the money, if paid by the time of such discovery, shall be refunded within five (5) business days from the Order cancellation date.
  • By sending the Order, the Buyer submits to Gucci and the Express Delivery Service his or her consent to processing of personal data, including cross-border transmission of data to the extent and subject to the terms foreseen by the Personal Data Processing Policy, in its version posted to the Website at the time of submitting personal data by the Buyer. Likewise, the Buyer submit to Gucci his or her consent to receive, via the provided contact details, advertisements from Gucci, its products and services.
  • All the textual, graphic images and other information available on the Website are the property of Gucci and/or its counterparties.
  • Any and all disputes and differences that may arise between the Parties in relation to the entry into, performance and termination of the retail sales contract shall be resolved amicable subject to the applicable laws of the Russian Federation. The disputes not amicably settled shall be referred to court as provided for in the applicable laws of the Russian Federation.
  • All the claims shall be addressed to Gucci at: 16 Petrovka Str., Moscow, 127051, Russia.
