1. General provisions

1.1.

These general conditions of sale (hereinafter, “General Conditions”) apply to all distance sales of “Gucci” products (hereinafter, “Products” or “Product”) carried out through the www.gucci.com website (hereinafter, “Website”).

1.2.

Distance selling services described in these General Conditions are only available to consumers (hereinafter, “Clients” or “Client”) being natural persons acting for purposes extraneous to their trade, business, craft and profession, aged over 18 (or, if they are minors, duly authorized by their legal representative).

1.3.

The language used to enter any contract through this Website is Slovenian.

1.4.

Clients are required to carefully read the General Conditions, which have been made available on the Website to enable Clients to acknowledge, store and reproduce them pursuant to Article 7, paragraph 1 of the Electronic Commerce Market Act (hereinafter, “the ECMA”). A copy of the General Conditions shall in any case be sent to the Client by email, as set out in Paragraph 7 of these General Conditions. Contracts with the Clients will be archived by Gucci with access for the Clients via the Website through their account.

1.5.

Contracts entered into with Gucci (as defined below) through the Website are governed by Slovenian law, including the Consumer Protection Act (hereinafter, “the CPA”) and the ECMA.

2. Identification of the vendor

2.1.

The vendor is G Commerce Europe S.p.A, a company part of PPR Luxury Group, with registered office at Via Don Lorenzo Perosi No. 6, Scandicci, Italy, VAT number 5142860484, Tax number: 00338740343 (hereinafter, “Gucci”).

3. Information on Products and their availability

3.1.

Information on Products, along with the relevant product codes, are available on the Website. This information is provided in accordance with Article 43.b of the CPA.

3.2.

The Website does not contain every Product. The Products available on the Website are a selection of items normally available in stores such as bags, shoes, leather goods, luggage, clothing, jewellery, watches, sunglasses, accessories and luxury goods. Depictions of the Products displayed on the Website may not correspond to their actual appearance. For any further information, the Client may contact the nearest authorised Gucci store. Not all Products described on the Website are or will be available from all Gucci stores.

3.3.

All the Products are subject to availability. Gucci reserves the right at any time to alter limits on quantities and/or types of Products available online from the Website. The style, models and colours of the Products described on the Website may be changed without notice. During the transaction process, an automatic response will inform the Client when the order will be fulfilled or if the order cannot be processed due to the unavailability of the ordered Product.

4. Price

4.1.

The prices of the Products are indicated on the Website in Euros and are inclusive of all applicable taxes and charges. Delivery costs shall be added to the price of the Products and are indicated separately on the order form.

4.2.

Gucci regularly verifies that all the prices displayed on the Website are correct, however, cannot guarantee the absence of errors. In the event that an error in the pricing of a Product is detected, Gucci shall offer the Client the opportunity to purchase the Product at the correct price or to cancel the order.

4.3.

The information displayed on the Website does not represent an offer by Gucci.

5. Purchases

5.1.

The essential characteristics and the price of each Product are provided for each Product displayed on the Website.

5.2.

Before they submit an order proposal, Clients should ensure that they read and understand all the instructions provided during the purchase procedure along with these General Conditions, because they will be bound by all of them once a contract comes into existence. To purchase a Product, Clients must fill in an order proposal and send it to Gucci through the Website. Clients must place the Product in their “shopping bag” and, after having read and accepted these General Conditions, with particular regard to the delivery charges and the conditions for the right of withdrawal, as well as after having read the privacy policy statement, must select the desired payment method and choose the “place order” option.

5.3.

If Clients need to correct any errors in data they have entered, they should follow process provided on the Website, before sending their order proposal. In particular, Clients may alter the quantity of Products that they intend to purchase by adding or removing one or more Products from their “shopping bag”.

5.4.

By sending an order proposal to Gucci, the Client acknowledges and declares that (s)he has read all the instructions provided during the purchase procedure and fully accepts these General Conditions.

5.5.

Without prejudice to the use of data described in the privacy policy statement and subject to the express consent of the Client, the order proposal and the Client’s data related to that order proposal may be kept by Gucci for the period required by applicable legislation.

6. Method of payment

6.1.

Clients may pay for the Products and the relevant delivery charges by credit card or by bank transfer.

6.2.

Gucci accepts payments made with the following credit cards:

6.3.

The transactions will be debited from the Client’s credit card only after:

(i) the credit card data has been verified;

(ii) the authorisation to debit the card has been received from the issuer of the card used by the Client, and

(iii) the availability of the Product has been confirmed by Gucci and the order is therefore ready to be fulfilled.

6.4.

No debit shall be made at the moment of transmission of the order proposal, with the exception of the charge necessary to check the credit card’s validity, if any.

6.5.

Gucci also accepts payments made by bank transfer to the following IBAN code: IT25 N030 5101 6990 0000 0000 136, BARCLAYS BANK PLC, BIC BARCITMMBKO. All costs and expenses (including bank charges) associated with the bank transfer, invoiced, as the case may be, to the Client by his/her bank, shall be borne by the Client.

6.6

In the event that, for any reason, it is impossible to debit amounts due from the Client, the transaction shall be stopped and the sale cancelled.

7. Conclusion of the contract

7.1.

The contract between Gucci and the Client shall be deemed to be executed at the moment that the Client receives confirmation from Gucci that his/her order proposal, sent through the process set out on the Website, has been concluded successful, once the availability of the Product has been verified and the price for the purchase has been debited to the Client’s credit card or, in the case of payment by bank transfer, confirmation of the receipt of the bank transfer has been received. The Client’s order proposal shall become binding on Gucci when the Website purchase procedure is completed without error.

7.2.

Gucci reserves the right to partially fulfil any order proposal in the event that one or more of the Products ordered by the Client is not available. In such cases, only the sum relating to the partially fulfilled order proposal shall be debited.

7.3.

Gucci shall not be liable for errors due to the Client’s connection to the Website.

7.4.

In accordance with the provisions of Articles 43.b, paragraph 1 and 43.c, paragraphs 1 and 2 of the CPA, at the moment of confirmation of the order or execution of the contract, Gucci shall provide the Client, by email, a summary of the General Conditions, information on the essential characteristics of the purchased Products, a detailed indication of the price and means of payment, information on delivery charges, information on the conditions and methods to exercise the right of withdrawal, including information on the exclusion of the right of withdrawal for personalised Products, the address to which complaints may be addressed, information on support services and on existing commercial terms. The Client should immediately review this communication and notify Gucci of any errors or omissions immediately.

8. Invalidity of the order proposal

8.1.

Notwithstanding the provisions of Paragraph 7 above, no order proposal shall be considered as accepted by Gucci nor shall any contract be concluded between Gucci and the Client if Gucci has reasonable reason to believe that the Client:

(i) intends to purchase the Products for commercial or professional purposes;

(ii) is not a bona fide Client; or

(iii) attempts to exercise a right of cancellation in any illegitimate manner.

8.2.

In such cases, the order proposal sent by the Client shall be void and have no effect. Gucci shall notify the Client, by email, of its non-acceptance of the order proposal and the failure to conclude the contract and shall also cancel any debit and/or charge against the Client.

9. Transport and delivery

9.1.

For security reasons, Products purchased from the Website shall be delivered to the address registered on the credit card unless otherwise indicated by the Client. The signature of the Client or of a nominated adult over 18 years of age will be required at the time of delivery. Gucci cannot deliver to PO boxes.

9.2.

In case of payment by bank transfer, deliveries shall be sent once the transfer has been received in cleared funds by Gucci.

9.3.

For each order, Gucci shall invoice the Products by email or by post to the purchaser, pursuant to Italian Presidential Decree 445/2000 and Italian Legislative Decree 52/2004. The invoice will be based upon the information provided by the Client at the time of the order. No alterations to the invoice are possible after it has been issued.

9.4.

Delivery charges shall be borne by the Client and are indicated separately on the order form and invoice.

9.5.

All purchases shall be delivered by a selected courier service (e.g. UPS Express) (hereinafter, “Courier”) between Monday and Friday excluding Saturdays, Sundays and local or national holidays, from the day following that of the confirmation of acceptance of the order proposal, on the basis of the indicated availability. Gucci is not responsible for delays that are unforeseeable and/or attributable exclusively to the Courier.

9.6.

In all cases, except those of force majeure or unforeseeable circumstances, in accordance with Article 43.e of the CPA, the Products shall be delivered within 30 (thirty) days from the day following that of the contract conclusion as per Paragraph 7.1 above, unless Gucci notifies the Client, including by email, within the same term or by the last date agreed for delivery, of the ordered Products being unavailable, including temporarily unavailable. In this event, Gucci shall reimburse any sums paid by the Client in respect of the order.

9.7.

In the event that, in response to Gucci’s notification of a delay in the delivery, the Client wishes to cancel the order, any amount already paid by the Client shall be reimbursed as soon as possible, in all cases no later than 30 (thirty) days of the date of receipt of the Client’s notification of cancellation of the order, with the exception of personalised Products, which are subject to Paragraph 12 below.

9.8.

The Client or his/her nominated representative must be present at the delivery address indicated on the order for delivery of the Products. At the time of delivery of the Products by the Courier, the Client is required to verify:

(i) that the number of items being delivered corresponds to that indicated on the delivery note; and

(ii) that the packaging and its seals are intact, undamaged, not wet or altered in any manner. Any damages to the packaging and/or the Product, or discrepancies in the number of items or documentation must be immediately indicated in writing on the Courier’s delivery note. Once the Courier’s document has been signed and no objection has been raised by the Client, the Client may not make any objection to the exterior characteristics of the consigned parcel.

10. Dispatching and delivery confirmation

10.1.

Gucci shall send the Client a confirmation email once the Products are dispatched and a further communication once the Products have been delivered.

11. Wrapping or packaging

11.1.

Products purchased from the Website are delivered with the same Gucci standard packaging as provided in Gucci stores.

12. Personalised Products

12.1.

In accordance with the provisions of Article 43.č, paragraph 5, point 2 of the CPA, subject to Paragraph 15 below, the right of withdrawal, to cancel or return, which would otherwise be available, does not apply to orders for personalised Products, such as, for example, those with the Client’s initials engraved on the Product. The Client is aware that images on the Website do not necessarily correspond to reality: images and photographs of the engraving may not reflect the actual appearance of the final product.

13. Right of withdrawal and cancellation of orders

13.1.

Gucci seeks the complete satisfaction of its Clients. The Client has the right to withdraw from the contract without specifying any reason, by returning the Products, purchased from the Website, within 14 (fourteen) days of the date the Products were received. This applies to all Products other than the personalised ones, which are subject to Paragraph 12.

13.2.

To exercise the right of withdrawal, the Client should email the following to assistance@si-onlineshopping.gucci.com:

  • an indication of his/her intention to exercise the right of withdrawal;
  • an indication of the Products for which the Client wishes to exercise the right of withdrawal;
  • the order number; and
  • in the event that the Client purchased the Products by bank transfer, the Client’s IBAN code to which the reimbursement is to be made.

13.3.

Upon exercising the right of withdrawal, Gucci shall reimburse the full price of the Products provided that they are returned by the Client unworn, unused and undamaged, accompanied by the relevant original invoice and the original Gucci packaging. Gucci shall accept returns and exchanges of Products that have been delivered with a return/exchange label or adhesive or seal only if the instructions for return indicated above are fully complied with and the label or adhesive or seal is intact and attached to the Product.

13.4.

Gucci reserves the right to refuse returns of Products that do not comply with these requirements. In cases of defective Products, the provisions of Paragraph15 “Lack of conformity” shall apply. Reimbursements shall be made by the same method of payment used for purchase. Products purchased online cannot be reimbursed or exchanged for money at Gucci stores. However, such Products may be exchanged for other Products at stores operated directly by Gucci, with the exclusion of outlet stores, corners, franchisees and duty free and subject to availability.

13.5.

The cost of returning the Products shall be borne by the Client. Any cost sustained by the Client in the return of Products is not refundable.

13.6.

Each delivery shall contain simple instructions for the return of the Products.

13.7.

Gucci undertakes to reimburse the Client within 30 days of the date of receipt of the Client’s notification of cancellation of the order or receipt of the withdrawal.

13.8.

Gucci shall send a notification email once the reimbursement has been made.

13.9.

It is recommended that the Products be returned using a courier, insuring the entire value of the item and using a tracked delivery service. Gucci cannot be responsible for reimbursement or compensation of Products returned but not received by Gucci due to loss, theft or damage that is not attributable to Gucci.

13.10.

If a Client wishes to amend or cancel an order already made, he/she must immediately send an email to assistance@si-onlineshopping.gucci.com. This e-mail must be sent before the Client receives confirmation of dispatch by Gucci.

13.11.

Gucci shall make every effort to satisfy the Client’s request. However, once the Product has been dispatched, the order cannot be cancelled or amended. Dispatched Products can however be returned as set out in these General Conditions.

14. Replacement of Products

14.1.

Gucci allows Clients to replace Products purchased on the Website.

14.2.

To replace a Product purchased on the Website, Clients should follow the procedure set out below.

14.3.

Clients who are not fully satisfied, or who believe there is a discrepancy in their order must keep all the documentation relating to the delivery and the Product itself in its original packaging, and immediately contact Gucci by email at assistance@si-onlineshopping.gucci.com, following the procedure set out in Paragraph 13 above.

14.4.

The Product to be replaced must be received by Gucci in its original conditions as when delivered, as provided in Paragraph 13.3.

14.5.

Under the replacement procedure, the amount paid by the Client shall firstly be reimbursed, through the payment system used by the Client for the purchase, as set out in Paragraph 6, before the new transaction can be made.

14.6.

To replace a Product, Clients must fill in the form provided with each delivered Product, clearly indicating the code and the size of the new Product that the Client wishes to receive.

14.7.

The placement of the new order is subject to the availability of the Products requested.

14.8.

Delivery costs for the return of the Product are borne by the Client.

14.9.

In the event that the Client is seeking replacement due to lack of conformity pursuant to Paragraph 15 below, the replacement Product shall be sent to the Client by courier without any additional delivery charge.

15. Lack of conformity

15.1.

If a Product sold by Gucci has manufacturing defects or in any case of alleged lack of conformity of Products sold by Gucci, the Client must immediately contact Online Support by email to assistance@si-onlineshopping.gucci.com, or by post to the following address:

15.2.

The legal guarantees established by Articles 37.a, 37.b and 37.c of the CPA apply to the sale of the Products. Under these Articles, the Client has the right to have the Products brought into conformity free of charge by repair or replacement, or, in case of failure of one of the remedies above, to have an appropriate reduction made in the price of the Products, or the contract cancelled. The Client waives these rights if it fails to notify Gucci of the lack of conformity within two months of the date on which the Client detected such lack of conformity. In any event, actions intended to assert a lack of conformity not maliciously concealed by Gucci shall automatically lapse twenty six months after the delivery of the Products.

16. Errors or inaccuracies

16.1.

Gucci undertakes to provide up to date information in the sections of the Website relating to the description and/or sale of the Products. However, Gucci cannot guarantee the Website will be error free. The Website in question may contain typing errors, inaccuracies or omissions, for example relating to the price or availability of the Product or in the information provided on the Product. Gucci reserves the right to correct such errors, inaccuracies or omissions, even after an order proposal has been sent, and also reserves the right to change or update information at any time without prior notice.

17. Guarantee of authenticity and intellectual property rights

17.1.

Gucci guarantees the authenticity of all Products purchased on the Website. Products bearing the Gucci trademark are produced with the best materials, are manufactured by artisans, and are all rigorously and fully MADE IN ITALY, with the sole exception of timekeeping Products, which are made in Switzerland and perfumes, which are made in France.

17.2.

The “Gucci” trademark, together with the set of figurative and non-figurative trademarks, service marks, present in the Products, the relevant accessories and/or packaging, marks consisting of shapes of goods, that are subject to registration or otherwise, together with all the illustrations, images and places protected by copyright, and more generally all the intellectual property rights relating to the Products, are and remain the exclusive property of the companies of Guccio Gucci S.p.A and Gucci America Inc., companies belonging to the PPR Luxury Group.

18. Applicable law and competent jurisdiction

18.1.

These General Conditions are governed by Slovenian law and must be interpreted in accordance with Slovenian laws.

18.2.

Any disputes arising from the interpretation, validity and/or execution of these General Conditions shall be subject to the mandatory territorial jurisdiction of the competent court of the place of residence or domicile of the Client/consumer.

1. Splošne določbe

1.1.

Ti splošni prodajni pogoji (v nadaljevanju »Splošni pogoji«) se uporabljajo za vsakršno prodajo »Gucci« izdelkov (v nadaljevanju »Izdelki« ali »Izdelek«) na daljavo, ki se opravi preko spletne strani www.gucci.com (v nadaljevanju »Spletna stran«).

1.2.

Storitve prodaje na daljavo, ki je opisana v teh Splošnih pogojih, so dostopne le potrošnikom (v nadaljevanju »Kupci« ali »Kupec«), ki so fizične osebe, ki delujejo za namene izven svojega trgovanja, dejavnosti, obrti in poklica, in so starejši od 18 let (ali so v primeru mladoletnosti pravilno pooblaščeni s strani svojega zakonitega zastopnika).

1.3.

Za sklenitev vsakršne pogodbe preko te Spletne strani se uporablja slovenski jezik.

1.4.

Kupci morajo skrbno prebrati Splošne pogoje, ki so dostopni na Spletni strani, Kupcem pa je tako omogočeno, da jih potrdijo, shranijo in reproducirajo v skladu s prvim odstavkom 7. člena Zakona o elektronskem poslovanju na trgu (v nadaljevanju »ZEPT«). Kopija Splošnih pogojev bo Kupcu v skladu s 7. odstavkom teh Splošnih pogojev v vsakem primeru posredovana po spletni pošti. Pogodbe s Kupci bo Gucci arhiviral, pri čemer bodo Kupci do njih lahko dostopali preko Spletne strani preko svojega računa.

1.5.

Pogodbe, ki so z Guccijem (kot je opredeljen spodaj) sklenjene preko Spletne strani, ureja slovensko pravo, vključno z Zakonom o varstvu potrošnikov (v nadaljevanju »ZVPot«) in z ZEPT.

2. Identifikacija prodajalca

2.1.

Prodajalec je družba G Commerce Europe S.p.A, del skupine PPR Luxury Group, ki ima sedež na naslovu Via Don Lorenzo Perosi No. 6, Scandicci, Italija, številka DDV: 5142860484, davčna številka: 00338740343 (v nadaljevanju »Gucci«).

3. Informacije o Izdelkih in njihovi razpoložljivosti

3.1.

Informacije o Izdelkih so skupaj z odgovarjajočimi oznakami proizvoda dostopne na Spletni strani. Te informacije so zagotovljene v skladu s 43.b členom ZVPot.

3.2.

Spletna stran ne vsebuje vseh Izdelkov. Na Spletni strani dostopni Izdelki predstavljajo izbor kosov, ki so običajno dostopni v trgovinah, kot denimo torbe, čevlji, usnjeni izdelki, kovčki, oblačila, nakit, ure, sončna očala, dodatki in luksuzno blago. Prikaz Izdelkov na Spletni strani se lahko ne sklada z njihovim dejanskim izgledom. Za vse nadaljnje informacije lahko Kupci stopijo v stik z najbližjo pooblaščeno Gucci prodajalno. Niso (oziroma ne bodo) vsi Izdelki, opisani na Spletni strani, dostopni v vseh Gucci prodajalnah.

3.3.

Vsi Izdelki so odvisni od razpoložljivosti. Gucci si pridržuje pravico, da kadarkoli spremeni omejitve količine in/ali tipov Izdelkov, ki so na voljo preko spleta na Spletni strani. Stil, modeli in barve Izdelkov, ki so opisani na Spletni strani, se lahko spremenijo brez obvestila. Med postopkom transakcije samodejni odgovor obvesti Kupca, kdaj bo naročilo izpolnjeno, ali da naročilo ne more biti izvršeno, ker naročeni Izdelek ni razpoložljiv.

4. Cena

4.1.

Cene Izdelkov so v evrih navedene na Spletni strani in vključujejo vse veljavne davke in dajatve. Stroški dostave se dodajo ceni Izdelkov in so na naročilnici navedeni ločeno.

4.2.

Gucci redno preverja pravilnost vseh cen, navedenih na Spletni strani, ne more pa zagotavljati odsotnosti napak. V primeru, da se opazi napaka v ceni Izdelka, Gucci Kupcu ponudi možnost, da Izdelek kupi po pravilni ceni ali naročilo prekliče.

4.3.

Informacije, ki so objavljene na Spletni strani, ne predstavljajo Guccijeve ponudbe.

5. Nakupi

5.1.

Za vsak Izdelek, prikazan na Spletni strani, so navedene njegove bistvene lastnosti in cena.

5.2.

Preden Kupci oddajo naročilo, morajo zagotoviti, da so prebrali in razumeli vsa navodila, zagotovljena med postopkom nakupa, vključno s temi Splošnimi pogoji, saj jih bodo z nastopom pogodbe vsa ta navodila zavezovala. Za nakup Izdelka morajo Kupci izpolniti naročilo in ga preko Spletne strani poslati Gucciju. Kupci morajo Izdelek dati v svojo »nakupovalno košarico« in po tem, ko so prebrali in sprejeli te Splošne pogoje s posebnim poudarkom na stroških dostave in pogojih za pravico do odpovedi ter po tem, ko so prebrali izjavo o varstvu osebnih podatkov, izbrati želeni način plačila ter izbrati možnost »oddaj naročilo«.

5.3.

Če morajo Kupci popraviti morebitne napake v podatkih, ki so jih vnesli, morajo pred oddajo naročila slediti za to predvidenemu postopku na Spletni strani. Kupci lahko še posebej spremenijo količino Izdelkov, ki jih nameravajo kupiti, in sicer z dodajanjem ali odstranjevanjem enega ali več Izdelkov iz svoje »nakupovalne košarice«.

5.4.

Ko Kupec pošlje Gucciju naročilo, s tem prizna in izjavi, da je prebral/prebrala vsa navodila, zagotovljena med postopkom nakupa, in da v celoti sprejema te Splošne pogoje.

5.5.

Brez poseganja v uporabo podatkov, opisano v izjavi o varstvu osebnih podatkov, ter ob izrecnem soglasju Kupca lahko Gucci naročilo in podatke Kupca, povezane z zadevnim naročilom, shrani za časovno obdobje, ki je določeno z veljavno zakonodajo.

6. Način plačila

6.1.

Kupci lahko Izdelke in pripadajoče stroške dostave plačajo s kreditno kartico ali preko bančnega nakazila.

6.2.

Gucci sprejema plačilo z naslednjimi kreditnimi karticami:

6.3.

Transakcije bodo knjižene v breme kreditne kartice Kupca šele po tem, ko:

(i) bodo preverjeni podatki kreditne kartice;

(ii) bo od izdajatelja kartice, ki jo uporablja Kupec, prejeta avtorizacija za bremenitev kartice, in

(iii) bo Gucci potrdil razpoložljivost Izdelka in bo naročilo tako pripravljeno na izpolnitev.

6.4.

V trenutku prenosa naročila se ne bo izvršila nobena bremenitev kartice, razen bremenitve za morebitne stroške, ki so potrebni za preverjanje veljavnosti kreditne kartice.

6.5.

Gucci sprejema tudi plačila preko bančnega nakazila na naslednjo IBAN kodo: IT25 N030 5101 6990 0000 0000 136, BARCLAYS BANK PLC, BIC BARCITMMBKO. Kupec nosi vse stroške in izdatke (vključno z bančnimi stroški), ki so povezani z bančnim nakazilom in jih je glede na posamezni primer Kupcu zaračunala njegova/njena banka.

6.6

Če je iz kateregakoli razloga nemogoče opraviti bremenitve za od Kupca dolgovane zneske, se transakcija ustavi, prodaja pa prekliče.

7. Sklenitev pogodbe

7.1.

Pogodba med Guccijem in Kupcem se šteje za sklenjeno v trenutku, ko Kupec od Guccija prejme potrdilo, da je bilo njegovo/njeno naročilo, ki je bilo poslano preko postopka, določenega na Spletni strani, uspešno zaključeno, po tem ko je bila preverjena razpoložljivost Izdelka in ko je bila kreditna kartica Kupca bremenjena za ceno nakupa, oziroma v primeru plačila preko bančnega nakazila, ko je prejeto potrdilo o prejemu bančnega nakazila. Naročilo Kupca postane za Gucci zavezujoče, ko je postopek nakupa preko Spletne strani zaključen brez napake.

7.2.

Gucci si pridržuje pravico do delne izpolnitve kateregakoli naročila v primeru nerazpoložljivosti enega ali večih Izdelkov, ki jih je Kupec naročil. V tem primeru se bremenitev opravi le za znesek, ki se nanaša na delno izpolnjeno naročilo.

7.3.

Gucci ne odgovarja za napake zaradi povezave Kupca na Spletno stran.

7.4.

V skladu z določbami prvega odstavka 43.b člena ter prvega in drugega odstavka 43.c člena ZVPot v trenutku potrditve naročila ali sklenitve pogodbe Gucci Kupcu po spletni pošti zagotovi povzetek Splošnih pogojev, informacije o bistvenih lastnostih kupljenih Izdelkov, podrobno navedbo cene in načina plačila, informacije o stroških dostave, informacije o pogojih in postopkih za uveljavljanje pravice do odpovedi, vključno z informacijami o izključenosti pravice do odpovedi za personalizirane Izdelke, naslov, na katerega je mogoče nasloviti pritožbe, informacije o podpornih storitvah in informacije o obstoječih tržnih pogojih. Kupec mora poslano dokumentacijo nemudoma pregledati in Gucci nemudoma obvestiti o morebitnih napakah ali izpustitvah.

8. Neveljavnost naročila

8.1.

Ne glede na določila iz zgornjega 7. odstavka se ne bo nobeno naročilo štelo za sprejeto s strani Gucci niti ne bo med Gucci in Kupcem sklenjena nobena pogodba, če obstaja razumen razlog, da Gucci meni, da Kupec:

(i) namerava Izdelke kupiti v tržne ali poslovne namene;

(ii) ni dobroveren Kupec; ali

(iii) poskuša pravico do odpovedi uveljaviti na kakršenkoli nezakonit način.

8.2.

V takšnih primerih je naročilo, poslano s strani Kupca, nično in brez vsakršnega učinka. Gucci Kupca po spletni pošti obvesti o nesprejetju naročila in o nesklenitvi pogodbe ter prekine tudi vsakršno bremenitev in/ali obračun Kupcu.

9. Transport in dostava

9.1.

Iz varnostnih razlogov se Izdelki, kupljeni preko Spletne strani, dostavijo na naslov, ki je naveden na kreditni kartici, razen v primeru, da Kupec navede drugače. V trenutku dostave se zahteva podpis Kupca ali imenovanega odraslega v starosti nad 18 let. Gucci ne more dostavljati v poštne predale.

9.2.

V primeru plačila preko bančnega nakazila se pošiljke pošljejo po tem, ko Gucci prejme nakazilo v razpoložljiva sredstva.

9.3.

Za vsako naročilo Gucci kupcu po spletni pošti ali po običajni pošti pošlje račun v skladu z italijansko predsedniško uredbo 445/2000 in italijanskim zakonodajnim odlokom 52/2004. Račun je osnovan na informacijah, ki jih v trenutku nakupa posreduje Kupec. Ko je račun izdan, ga ni več mogoče spreminjati.

9.4.

Stroške dostave, ki so ločeno navedeni na naročilu in na računu, nosi Kupec.

9.5.

Vsi nakupi bodo dostavljeni z izbrano kurirsko službo (denimo UPS Express) (v nadaljevanju »Kurir«) med ponedeljkom in petkom, ne pa ob sobotah, nedeljah in ob lokalnih ali državnih praznikih, od dne, ki sledi dnevu potrditve sprejetja naročila, glede na navedeno razpoložljivost. Gucci ne odgovarja za nepredvidljive zakasnitve in/ali za zakasnitve, ki se lahko pripišejo izključno Kurirju.

9.6.

V vsakem primeru, razen v primeru višje sile ali nepredvidljivih okoliščin, bodo v skladu s 43.e členom ZVPot Izdelki dostavljeni v 30 (tridesetih) dneh od dne, ki sledi dnevu sklenitve pogodbe po prvi točki 7. odstavka zgoraj, razen v primeru, da Gucci v istem obdobju ali do zadnjega dogovorjenega datuma za dostavo obvesti Kupca, vključno z obvestilom po spletni pošti, da naročeni Izdelki niso razpoložljivi, vključno z začasno nerazpoložljivostjo. V tem primeru Gucci povrne vse zneske, ki jih je Kupec plačal v povezavi z naročilom.

9.7.

V primeru, da Kupec po Guccijevem obvestilu o zakasnitvi dostave želi preklicati naročilo, se kakršenkoli znesek, ki ga je Kupec že plačal, povrne v najkrajšem možnem času, v nobenem primeru pa ne pozneje kot v 30 (tridesetih) dneh po datumu prejema obvestila Kupca o preklicu naročila, z izjemo personaliziranih Izdelkov, ki so obravnavani v spodnjem 12. odstavku.

9.8.

Kupec ali njegov/njen imenovani zastopnik morata biti prisotna na naslovu za dostavo, ki je naveden na naročilu za dostavo Izdelkov. Ko Kurir dostavi Izdelke, je Kupec dolžan preveriti:

(i) da se število dostavljenih kosov ujema s številom kosov, navedenim na dobavnici; in

(ii) da so embalaža in zatesnitve embalaže cele, nepoškodovane, da niso mokre ali na kakršenkoli način spremenjene. Vsakršna škoda na embalaži in/ali na Izdelku, ali neskladje v številu kosov ali v dokumentaciji mora biti nemudoma pisno označeno na Kurirjevi dobavnici. Ko je Kurirjev dokument podpisan in Kupec ni ugovarjal zoper karkoli, Kupec ne more več ugovarjati zoper zunanje lastnosti odpremljene pošiljke.

10. Odprema in potrditev dostave

10.1.

Gucci Kupcu pošlje potrditveno e-sporočilo, ko so Izdelki odposlani, in nadaljnje obvestilo, ko so bili Izdelki dostavljeni.

11. Embaliranje ali pakiranje

11.1.

Izdelki, ki so bili kupljeni preko Spletne strani, se dostavijo v enaki standardni Gucci embalaži, kot se zagotavlja v Gucci trgovinah.

12. Personalizirani Izdelki

12.1.

V skladu z določbami druge točke petega odstavka 43.č člena ZVPot ter ob upoštevanju spodnjega 15. odstavka pravica do odpovedi, preklica ali vračila, ki bi bila sicer na razpolago, ne velja za naročila personaliziranih Izdelkov, kot denimo tistih z vgraviranimi začetnicami Kupca na Izdelku. Kupec se zaveda, da slike na Spletni strani ne odražajo nujno realnega stanja; slike in fotografije gravur ne odražajo nujno dejanskega izgleda končnega izdelka.

13. Pravica do odpovedi in preklica naročil

13.1.

Gucci želi doseči popolno zadovoljstvo svojih Kupcev. Kupec ima pravico, da odstopi od pogodbe, ne da bi za to navajal kakršnekoli razloge, tako da vrne Izdelke, kupljene preko Spletne strani, v 14 (štirinajstih) dneh od datuma prejema Izdelkov. To velja za vse Izdelke, razen za personalizirane Izdelke, ki so obravnavani v 12. odstavku.

13.2.

Da bi uveljavil svojo pravico do odpovedi, mora Kupec na spletni naslov assistance@si-onlineshopping.gucci.com poslati naslednje:

  • navedbo svoje namere uveljaviti pravico do odpovedi na podlagi 43.č člena ZVPot;
  • navedbo Izdelkov, za katere Kupec želi uveljaviti pravico do odpovedi;
  • številko naročila; in
  • v primeru, da je Kupec Izdelke kupil preko bančnega nakazila, IBAN kodo Kupca, na katero naj se opravi povračilo.

13.3.

Ob uveljavitvi pravice do odpovedi Gucci povrne polno ceno Izdelkov pod pogojem, da Kupec Izdelke vrne nenošene, neuporabljene in nepoškodovane, opremljene z ustreznim računom v izvirniku in v originalni Gucci embalaži. Gucci sprejema vračila in zamenjave Izdelkov, ki so bili dostavljeni z oznako o vračanju/zamenjavi ali z adhezivom ali z zatesnitvijo le, če so bila v celoti upoštevana zgoraj navedena navodila za vračanje, in če so oznaka, adheziv ali zatesnitev celi in priloženi Izdelku.

13.4.

Gucci si pridržuje pravico do zavrnitve vračil Izdelkov, ki tem zahtevam ne ustrezajo. V primeru Izdelkov z napako se uporabljajo določbe iz 15. odstavka »Neskladnost«. Povračila se izvedejo z enakim načinom plačila, uporabljenim za nakup. Za Izdelke, kupljene na spletu, povračilo ali menjava za denar v Gucci trgovinah ni mogoča. Takšni Izdelki pa se lahko zamenjajo za druge Izdelke v trgovinah, ki jih neposredno vodi Gucci, z izjemo tovarniških prodajaln (outlet centrov), manjših prodajaln, franšiz in duty free prodajaln, in pod pogojem razpoložljivosti.

13.5.

Stroške vračila Izdelkov nosi Kupec. Stroški, ki nastanejo Kupcu pri vračilu Izdelkov, niso vračljivi.

13.6.

Vsaka dostavljena pošiljka vsebuje preprosta navodila za vračilo Izdelkov.

13.7.

Gucci se obvezuje, da bo Kupcu opravil povračilo v 30 dneh od datuma prejema obvestila Kupca o preklicu naročila ali od prejema Kupčeve odpovedi.

13.8.

Gucci bo po izvedbi povračila po spletni pošti poslal obvestilo.

13.9.

Priporočeno je, da se Izdelki vrnejo preko kurirja, da se celotna vrednost pošiljke zavaruje ter da se uporablja kurirsko službo, ki ji je moč slediti. Gucci ne more prevzeti odgovornosti za povračilo ali nadomestilo za škodo v zvezi z Izdelki, ki so bili vrnjeni, vendar jih Gucci ni prejel zaradi izgube, kraje ali poškodbe, ki je ni moč pripisati Gucciju.

13.10.

Če želi Kupec spremeniti ali preklicati že podano naročilo, mora na spletni naslov assistance@si-onlineshopping.gucci.com nemudoma poslati e-sporočilo. To sporočilo mora biti poslano, preden Kupec prejme potrdilo o odpremi s strani Guccija.

13.11.

Gucci si po svojih najboljših močeh prizadeva, da bi ustregel zahtevam Kupca. Ko pa je bil Izdelek že odposlan, se naročila ne more več preklicati ali spremeniti. Odposlane Izdelke pa se lahko vrne v skladu s pravili, ki so navedena v teh Splošnih pogojih.

14. Zamenjava Izdelkov

14.1.

Gucci omogoča Kupcem zamenjavo Izdelkov, kupljenih preko Spletne strani.

14.2.

Za zamenjavo Izdelka, kupljenega preko Spletne strani, morajo Kupci slediti spodaj navedenemu postopku.

14.3.

Kupci, ki niso popolnoma zadovoljni, ali Kupci, ki menijo, da je v njihovem naročilu prišlo do odstopanj, morajo obdržati vso dokumentacijo v povezavi z dostavo ter sam Izdelek v njegovi originalni embalaži ter nemudoma stopiti v stik z Guccijem preko spletnega naslova assistance@si-onlineshopping.gucci.com in slediti postopku, navedenemu v 13. odstavku zgoraj.

14.4.

Izdelek, ki je predmet zamenjave, mora Gucci prejeti v njegovem izvirnem stanju, v kakršnem je Izdelek bil ob dostavi, kot je določeno v tretji točki 13. odstavka.

14.5.

V postopku zamenjave bo najprej povrnjen znesek, ki ga je plačal Kupec, preko plačilnega sistema, ki ga je Kupec uporabil za nakup, kot je določeno v 6. odstavku, preden se lahko izvrši nova transakcija.

14.6.

Za zamenjavo Izdelka morajo Kupci izpolniti formular, ki je priložen vsakemu dostavljenemu Izdelku, na katerem morajo jasno navesti kodo in velikost novega Izdelka, ki ga Kupec želi prejeti.

14.7.

Pogoj za podajo novega naročila je razpoložljivost zahtevanih Izdelkov.

14.8.

Stroške dostave za vračilo Izdelka nosi Kupec.

14.9.

V primeru, da Kupec zahteva zamenjavo Izdelka zaradi neskladnosti na podlagi spodnjega 15. odstavka, se nadomestni Izdelek pošlje Kupcu preko kurirja brez kakršnihkoli dodatnih stroškov dostave.

15. Neskladnost

15.1.

Če ima Izdelek, ki ga prodaja Gucci, proizvodne napake, ali v vsakršnem primeru zatrjevane neskladnosti Izdelkov, ki jih prodaja Gucci, mora Kupec nemudoma stopiti v stik s Spletno podporo preko spletnega naslova assistance@si-onlineshopping.gucci.com, ali po običajni pošti na naslednjem naslovu:

15.2.

Za prodajo Izdelkov veljajo pravna jamstva po 37.a, 37.b in 37.c členu ZVPot. Po teh členih ima Kupec pravico, da se Izdelki brezplačno popravijo ali zamenjajo, ali, če katerokoli od omenjenih sredstev ni izpolnjeno, da se cena Izdelkov ustrezno zniža ali da se pogodba prekliče. Kupec se tej pravici odpove v primeru, da o neskladnosti Gucci ne obvesti v roku dveh mesecev od datuma, na katerega je Kupec opazil takšno neskladnost. V vsakem primeru bodo pravice, ki so namenjene uveljavitvi neskladnosti, ki je Gucci ni zlonamerno prikril, samodejno ugasnile po šestindvajsetih mesecih po dostavi Izdelkov.

16. Napake ali netočnosti

16.1.

Gucci se obvezuje, da bo v delih Spletne strani, ki se nanašajo na opis in/ali prodajo Izdelkov, zagotavljal najnovejše podatke. Vendar pa Gucci ne more zagotavljati, da bo Spletna stran brez napak. Zadevna Spletna stran lahko vsebuje tipkarske napake, netočnosti ali izpustke, denimo takšne, ki se nanašajo na ceno ali razpoložljivost Izdelka, ali na informacije o Izdelku. Gucci si pridržuje pravico, da takšne napake, netočnosti ali izpustke popravi tudi še po tem, ko je bilo naročilo že odposlano, in si pridržuje tudi pravico, da kadarkoli spremeni ali posodobi informacije brez predhodnega obvestila.

17. Zagotovilo avtentičnosti in pravic intelektualne lastnine

17.1.

Gucci zagotavlja avtentičnost vseh Izdelkov, kupljenih na Spletni strani. Izdelke, ki nosijo blagovno znamko Gucci, izdelujejo obrtniki iz najboljših materialov, in so vsi v celoti in popolnoma izdelani v Italiji; edina izjema so urni Izdelki, ki jih izdelujejo v Švici, ter parfumi, ki jih izdelujejo v Franciji.

17.2.

Blagovna znamka »Gucci« skupaj z naborom figurativnih in nefigurativnih blagovnih znamk, storitvenih znamk, predstavljenih v Izdelkih, pripadajočih dodatkih in/ali embalaži, znamke, ki sestojijo iz oblik izdelkov, ki so predmet registracije ali so drugače zaščitene z avtorsko pravico, skupaj z vsemi ilustracijami, slikami in kraji, ter bolj splošno, vse pravice intelektualne lastnine, ki se nanašajo na Izdelke, so in ostajajo izključna last družb Guccio Gucci S.p.A. in Gucci America Inc., družb, ki spadata v skupino PPR Luxury Group.

18. Pravo, ki se uporablja in pristojna jurisdikcija

18.1.

Te Splošne pogoje ureja slovensko pravo in se morajo v skladu s slovenskim pravom tudi razlagati.

18.2.

Kakršnikoli spori, ki bi izhajali iz razlage, veljavnosti in/ali izvrševanja teh Splošnih pogojev, so predmet obvezne krajevne pristojnosti stvarno pristojnega sodišča po stalnem prebivališču ali prebivališču Kupca/potrošnika.

19.1.
