1. General provisions

1.1.

These general conditions of sale (hereinafter, “General Conditions”) apply to all distance sales of “Gucci” products (hereinafter, “Products” or “Product”) carried out through the www.gucci.com website (hereinafter, “Website”).

1.2.

Distance selling services described in these General Conditions are only available to consumers (hereinafter, “Clients” or “Client”) being natural persons acting for purposes extraneous to their trade, business, craft and profession, aged over 18 (or, if they are minors, duly authorized by their legal representative).

1.3.

The language used to enter any contract through this Website is Danish.

1.4.

Clients are required to carefully read the General Conditions, which have been made available on the Website to enable Clients to acknowledge, store and reproduce them pursuant to Article 11, paragraph 2, of the Danish Act on Electronic Commerce no. 227 of 22 April 2002 (in Danish “E-handelsloven” and hereinafter, the “Ecommerce Act”). An electronic or hard copy of the General Conditions can be sent to the Client by email, should the Client request this. Contracts with the Clients will be archived by Gucci with access for the Clients via the Website through their account.

1.5.

Contracts entered into with Gucci (as defined below) through the Website are governed by Danish law, including the Danish Act on Consumer Contracts no. 451 of 9 June 2004 (in Danish “Forbrugeraftaleloven” and hereinafter, “Consumer Act”) and the Ecommerce Act.

2. Identification of the vendor

2.1.

The vendor is G Commerce Europe S.p.A, a company part of PPR Luxury Group, with registered office at Via Don Lorenzo Perosi No. 6, Scandicci, Italy, VAT number 5142860484, Tax number: 00338740343 (hereinafter, “Gucci”).

3. Information on Products and their availability

3.1.

Information on Products, along with the relevant product codes, are available on the Website. This information is provided in accordance with Article 11 of the Consumer Act.

3.2.

The Website does not contain every Product. The Products available on the Website are a selection of items normally available in stores such as bags, shoes, leather goods, luggage, clothing, jewellery, watches, sunglasses, accessories and luxury goods. Depictions of the Products displayed on the Website may not correspond to their actual appearance. For any further information, the Client may contact the nearest authorised Gucci store. Not all Products described on the Website are or will be available from all Gucci stores.

3.3.

All the Products are subject to availability. Gucci reserves the right at any time to alter limits on quantities and/or types of Products available online from the Website. The style, models and colours of the Products described on the Website may be changed without notice. During the transaction process, an automatic response will inform the Client when the order will be fulfilled or if the order cannot be processed due to the unavailability of the ordered Product.

4. Price

4.1.

The prices of the Products are indicated on the Website in Euros, but the amount will be debited in Danish kroner at the bank’s EUR/Danish kroner exchange rate on the debit day, and are inclusive of all applicable taxes and charges. Delivery costs shall be added to the price of the Products and are indicated separately on the order form.

4.2.

Gucci regularly verifies that all the prices displayed on the Website are correct, however, cannot guarantee the absence of errors. In the event that an error in the pricing of a Product is detected, Gucci shall offer the Client the opportunity to purchase the Product at the correct price or to cancel the order.

4.3.

The information displayed on the Website does not represent an offer by Gucci.

5. Purchases

5.1.

The essential characteristics and the price of each Product are provided for each Product displayed on the Website.

5.2.

Before they submit an order proposal, Clients should ensure that they read and understand all the instructions provided during the purchase procedure along with these General Conditions, because they will be bound by all of them once a contract comes into existence. To purchase a Product, Clients must fill in an order proposal and send it to Gucci through the Website. Clients must place the Product in their “shopping bag” and, after having read and accepted these General Conditions, with particular regard to the delivery charges and the conditions for the right of withdrawal, as well as after having read the privacy policy statement, must select the desired payment method and choose the “place order” option.

5.3.

If Clients need to correct any errors in data they have entered, they should follow process provided on the Website, before sending their order proposal. In particular, Clients may alter the quantity of Products that they intend to purchase by adding or removing one or more Products from their “shopping bag”.

5.4.

By sending an order proposal to Gucci, the Client acknowledges and declares that (s)he has read all the instructions provided during the purchase procedure and fully accepts these General Conditions.

5.5.

Without prejudice to the use of data described in the privacy policy statement and subject to the express consent of the Client, the order proposal and the Client’s data related to that order proposal may be kept by Gucci for the period required by applicable legislation.

6. Method of payment

6.1.

Clients may pay for the Products and the relevant delivery charges by credit card or by bank transfer.

6.2.

Gucci accepts payments made with the following credit cards:

6.3.

The transactions will be debited from the Client’s credit card only after:

(i) the credit card data has been verified;

(ii) the authorisation to debit the card has been received from the issuer of the card used by the Client, and

(iii) the availability of the Product has been confirmed by Gucci and the order is therefore ready to be fulfilled.

6.4.

No debit shall be made at the moment of transmission of the order proposal, with the exception of the charge necessary to check the credit card’s validity, if any.

6.5.

Gucci also accepts payments made by bank transfer to the following IBAN code: IT25 N030 5101 6990 0000 0000 136, BARCLAYS BANK PLC, BIC BARCITMMBKO . All costs and expenses (including bank charges) associated with the bank transfer, invoiced, as the case may be, to the Client by his/her bank, shall be borne by the Client.

6.6.

In the event that, for any reason, it is impossible to debit amounts due from the Client, the transaction shall be stopped and the sale cancelled.

7. Conclusion of the contract

7.1.

The contract between Gucci and the Client shall be deemed to be executed at the moment that the Client receives confirmation from Gucci that his/her order proposal, sent through the process set out on the Website, has been concluded successfully, once the availability of the Product has been verified and the price for the purchase has been debited to the Client’s credit card or, in the case of payment by bank transfer, confirmation of the receipt of the bank transfer has been received. The Client’s order proposal shall become binding on Gucci when the Website purchase procedure is completed without error.

7.2.

Gucci reserves the right to partially fulfil any order proposal in the event that one or more of the Products ordered by the Client is not available. In such cases, only the sum relating to the partially fulfilled order proposal shall be debited.

7.3.

Gucci shall not be liable for errors due to Client’s connection to the Website.

7.4.

In accordance with the provisions of Article 12 of the Consumer Act at the moment of confirmation of the order or execution of the contract, Gucci shall provide the Client, by email, a summary of the General Conditions, information on the essential characteristics of the purchased Products, a detailed indication of the price and means of payment, information on delivery charges, information on the conditions and methods to exercise the right of withdrawal, including information on the exclusion of the right of withdrawal for personalised Products, the address to which complaints may be addressed, information on support services and on existing commercial terms. The Client should immediately review this communication and notify Gucci of any errors or omissions immediately.

8. Invalidity of the order proposal

8.1.

Notwithstanding the provisions of Paragraph 7 above, no order proposal shall be considered as accepted by Gucci nor shall any contract be concluded between Gucci and the Client if Gucci has reasonable reason to believe that the Client:

(i) intends to purchase the Products for commercial or professional purposes;

(ii) is not a bona fide Client; or

(iii) attempts to exercise a right of withdrawal in any illegitimate manner.

8.2.

In such cases, the order proposal sent by the Client shall be void and have no effect. Gucci shall notify the Client, by email, of its non-acceptance of the order proposal and the failure to conclude the contract and shall also cancel any debit and/or charge against the Client.

9. Transport and delivery

9.1.

For security reasons, Products purchased from the Website shall be delivered to the address registered on the credit card unless otherwise indicated by the Client. The signature of the Client or of a nominated adult over 18 years of age will be required at the time of delivery. Gucci cannot deliver to PO boxes.

9.2.

In case of payment by bank transfer, deliveries shall be sent once the transfer has been received in cleared funds by Gucci.

9.3.

For each order, Gucci shall invoice the Products by email or by post to the purchaser. The invoice will be based upon the information provided by the Client at the time of the order. No alterations to the invoice are possible after it has been issued.

9.4.

Delivery charges shall be borne by the Client and are indicated separately on the order form and invoice.

9.5.

All purchases shall be delivered by a selected courier service (e.g. UPS Express) (hereinafter, “Courier”) between Monday and Friday excluding Saturdays, Sundays and local or national holidays, from the day following that of the confirmation of acceptance of the order proposal, on the basis of the indicated availability. Gucci is not responsible for delays that are unforeseeable and/or attributable exclusively to the Courier.

9.6.

In all cases, except those of force majeure or unforeseeable circumstances, the Products shall be delivered within 30 (thirty) days from the day following that of the contract conclusion as per Paragraph 7.1 above, unless Gucci notifies the Client, including by email, within the same term or by the last date agreed for delivery, of the ordered Products being unavailable, including temporarily unavailable. In this event, Gucci shall reimburse any sums paid by the Client in respect of the order.

9.7.

In the event that, in response to Gucci’s notification of a delay in the delivery, the Client wishes to cancel the order, any amount already paid by the Client shall be reimbursed as soon as possible, in all cases no later than 30 (thirty) days of the date of receipt of the Client’s notification of cancellation of the order, with the exception of personalised Products, which are subject to Paragraph 12 below.

9.8.

The Client or his/her nominated representative must be present at the delivery address indicated on the order for delivery of the Products. At the time of delivery of the Products by the Courier, the Client is required to verify:

(i) that the number of items being delivered corresponds to that indicated on the delivery note; and

(ii) that the packaging and its seals are intact, undamaged, not wet or altered in any manner. Any damages to the packaging and/or the Product, or discrepancies in the number of items or documentation must be immediately indicated in writing on the Courier’s delivery note. Once the Courier’s document has been signed and no objection has been raised by the Client, the Client may not make any objection to the exterior characteristics of the consigned parcel.

10. Dispatching and delivery confirmation

10.1.

Gucci shall send the Client a confirmation email once the Products are dispatched and a further communication once the Products have been delivered.

11. Wrapping or packaging

11.1.

Products purchased from the Website are delivered with the same Gucci standard packaging as provided in Gucci stores.

12. Personalised Products

12.1.

Subject to Paragraph 15 below, the right of withdrawal, to cancel or return, which would otherwise be available, does not apply to orders for personalised Products, such as, for example, those with the Client’s initials engraved on the Product. The Client is aware that images on the Website do not necessarily correspond to reality: images and photographs of the engraving may not reflect the actual appearance of the final product.

13. Right of withdrawal and cancellation of orders

13.1.

Gucci seeks the complete satisfaction of its Clients. Pursuant to Article 17 of the Consumer Act, the Client has the right to withdraw from the contract without specifying any reason, by returning the Products, purchased from the Website, within 14 (fourteen) days of the date the Products were received. This applies to all Products other than the personalised ones, which are subject to Paragraph 12.

13.2.

To exercise the right of withdrawal, the Client should email the following to assistance@dk-onlineshopping.gucci.com::

  • an indication of his/her intention to exercise the right of withdrawal pursuant to Article 17 of the Consumer Act;
  • an indication of the Products for which the Client wishes to exercise the right of withdrawal;
  • the order number; and
  • in the event that the Client purchased the Products by bank transfer, the Client’s IBAN code to which the reimbursement is to be made.

13.3.

Upon exercising the right of withdrawal, Gucci shall reimburse the full price of the Products provided that they are returned by the Client unworn, unused and undamaged, accompanied by the relevant original invoice and the original Gucci packaging. Gucci shall accept returns and exchanges of Products that have been delivered with a return/exchange label or adhesive or seal only if the instructions for return indicated above are fully complied with and the label or adhesive or seal is intact and attached to the Product.

13.4.

Gucci reserves the right to refuse returns of Products that do not comply with these requirements. In cases of defective Products, the provisions of Paragraph 15 “Lack of conformity” shall apply. Reimbursements shall be made by the same method of payment used for purchase. Products purchased online cannot be reimbursed or exchanged for money at Gucci stores. However, such Products may be exchanged for other Products at stores operated directly by Gucci, with the exclusion of outlet stores, corners, franchisees and duty free and subject to availability.

13.5.

The cost of returning the Products shall be borne by the Client. Any cost sustained by the Client in the return of Products is not refundable.

13.6.

Each delivery shall contain simple instructions for the return of the Products.

13.7.

Gucci undertakes to reimburse the Client within 30 (thirty) days of the date of receipt of the Client’s notification of cancellation of the order or receipt of the withdrawal.

13.8.

Gucci shall send a notification email once the reimbursement has been made.

13.9.

It is recommended that the Products be returned using a courier, insuring the entire value of the item and using a tracked delivery service. Gucci cannot be responsible for reimbursement or compensation of Products returned but not received by Gucci due to loss, theft or damage that is not attributable to Gucci.

13.10.

If a Client wishes to amend or cancel an order already made, he/she must immediately send an email to assistance@dk-onlineshopping.gucci.com. This e-mail must be sent before the Client receives confirmation of dispatch by Gucci.

13.11.

Gucci shall make every effort to satisfy the Client’s request. However, once the Product has been dispatched, the order cannot be cancelled or amended. Dispatched Products can however be returned as set out in these General Conditions.

14. Replacement of Products

14.1.

Gucci allows Clients to replace Products purchased on the Website.

14.2.

To replace a Product purchased on the Website, Clients should follow the procedure set out below.

14.3.

Clients who are not fully satisfied, or who believe there is a discrepancy in their order must keep all the documentation relating to the delivery and the Product itself in its original packaging, and immediately contact Gucci by email at assistance@dk-onlineshopping.gucci.com, following the procedure set out in Paragraph 13 above.

14.4.

The Product to be replaced must be received by Gucci in its original conditions as when delivered, as provided in Paragraph 13.3.

14.6.

To replace a Product, Clients must fill in the form provided with each delivered Product, clearly indicating the code and the size of the new Product that the Client wishes to receive.

14.7.

The placement of the new order is subject to the availability of the Products requested.

14.8.

Delivery costs for the return of the Product are borne by the Client.

14.9.

In the event that the Client is seeking replacement due to lack of conformity pursuant to Paragraph 15 below, the replacement Product shall be sent to the Client by courier without any additional delivery charge.

15. Lack of conformity

15.1.

If a Product sold by Gucci has manufacturing defects or in any case of alleged lack of conformity of Products sold by Gucci, the Client must immediately contact Online Support by email to assistance@dk-onlineshopping.gucci.com, or by post to the following address:

15.2.

The legal rights established by the Danish Act on Purchase of Goods no. 237 of 28 March 2003 (in Danish “Købeloven” and hereinafter the “Purchase of Goods Act”) apply to the sale of the Products. Under the specific terms and conditions of these Articles, the Client may have the right to have the Products brought into conformity free of charge by repair or replacement, or, in case of failure of one of the remedies above, to have an appropriate reduction made in the price of the Products, or, in case of material breach, the contract cancelled. The Client waives these rights if it fails to notify Gucci of the lack of conformity within two months of the date on which the Client detected such lack of conformity. In any event, actions intended to assert a lack of conformity not maliciously concealed by Gucci shall automatically lapse 26 (twenty six) months after the delivery of the Products.

16. Errors or inaccuracies

16.1.

Gucci undertakes to provide up to date information in the sections of the Website relating to the description and/or sale of the Products. However, Gucci cannot guarantee the Website will be error free. The Website in question may contain typing errors, inaccuracies or omissions, for example relating to the price or availability of the Product or in the information provided on the Product. Gucci reserves the right to correct such errors, inaccuracies or omissions, even after an order proposal has been sent, and also reserves the right to change or update information at any time without prior notice.

17. Guarantee of authenticity and intellectual property rights

17.1.

Gucci guarantees the authenticity of all Products purchased on the Website. Products bearing the Gucci trademark are produced with the best materials, are manufactured by artisans, and are all rigorously and fully MADE IN ITALY, with the sole exception of timekeeping Products, which are made in Switzerland and perfumes, which are made in France.

17.2.

The “Gucci” trademark, together with the set of figurative and non-figurative trademarks, service marks, present in the Products, the relevant accessories and/or packaging, marks consisting of shapes of goods, that are subject to registration or otherwise, together with all the illustrations, images and places protected by copyright, and more generally all the intellectual property rights relating to the Products, are and remain the exclusive property of the companies of Guccio Gucci S.p.A and Gucci America Inc., companies belonging to the PPR Luxury Group.

18. Applicable law and competent jurisdiction

18.1.

These General Conditions are governed by Danish law and must be interpreted in accordance with Danish laws.

18.2.

Any disputes arising from the interpretation, validity and/or execution of these General Conditions shall be subject to the mandatory territorial jurisdiction of the competent court of the place of residence or domicile of the Client/consumer.

1. Almindelige bestemmelser

1.1.

Disse almindelige salgsbetingelser (herefter “Salgsbetingelserne”) gælder for ethvert fjernsalg af “Gucci”- produkter (herefter, “Produkter” eller “Produkt”), der gennemføres på www.gucci.com (herefter “Webstedet”).

1.2.

Den form for fjernsalg, som disse Salgsbetingelser omhandler, kan kun gennemføres af forbrugere (herefter “Kunder” eller “Kunden”), som er fysiske personer over 18 år, og som ikke handler i erhvervsmæssigt øjemed. Kunder under 18 år kan gennemføre en handel med samtykke fra en forælder eller værge.

1.3.

Dansk bruges som sprog i enhver aftale, der indgås på dette Websted.

1.4.

Kunden er forpligtet til nøje at gennemlæse Salgsbetingelserne, der er tilgængelige på dette Websted, således at Kunden har mulighed for at acceptere, oplagre og gengive disse i henhold til E-handelslovens § 11, stk. 2 (herefter ”E-handelsloven”). 2. Sælger

2.1.

3. Produktoplysninger og -tilgængelighed

3.1.

På Webstedet findes oplysninger om Produkterne samt de relevante produktkoder. Disse oplysninger gives i henhold til Forbrugeraftalelovens § 11.

3.2.

Ikke alle Guccis produkter er tilgængelige på Webstedet. På Webstedet udbydes et udvalg af Produkter, der normalt sælges i forretningerne, f.eks. tasker, sko, lædervarer, bagage, beklædning, smykker, ure, solbriller, tilbehør og luksusvarer. Det kan forekomme, at afbildningen af et Produkt på Webstedet ikke er i overensstemmelse med Produktets faktiske fremtoning. Yderligere oplysninger fås ved henvendelse til den nærmeste autoriserede Gucci-forretning. Produkter, der udbydes på Webstedet, føres ikke nødvendigvis i alle Gucci-forretninger.

3.3.

Der tages forbehold for udsolgte Produkter. Gucci kan til enhver tid ændre mængden og/eller typen af Produkter, der udbydes online på Webstedet. Modeller og farver for de Produkter, der er beskrevet på Websitet, kan ændres uden varsel. I forbindelse med ordreafgivelsen modtager Kunden et automatisk svar, som indeholder information om, hvornår ordren leveres, eller om at ordren ikke kan gennemføres, fordi det bestilte Produkt ikke er på lager.

4. Pris

4.1.

Prisen for Produkterne er angivet i EUR på Webstedet. Beløbet debiteres dog i DKK til bankens valutakurs for EUR/DKK på debiteringsdagen, og det er inklusive skatter og afgifter. Prisen for Produktet tillægges leveringsomkostninger, der anføres særskilt på ordresedlen.

4.2.

Gucci kontrollerer regelmæssigt, at de på Webstedet angivne priser er korrekte, men der tages dog forbehold for eventuelle fejl. Såfremt en pris er fejlagtigt angivet, vil Gucci tilbyde Kunden at købe Produktet til den korrekte pris eller at annullere ordren.

4.3.

De oplysninger, der findes på Webstedet, udgør ikke et tilbud fra Guccis side.

5. Indkøb

5.1.

For samtlige Produkter på Webstedet er der angivet pris samt produktbeskrivelse.

5.2.

Det anbefales, at Kunden inden ordreafgivelse sætter sig grundigt ind i bestemmelserne i disse Salgsbetingelser samt i de anvisninger, der gives i løbet af købsprocessen, da Kunden vil være bundet heraf, når der er indgået endelig aftale. For at købe et Produkt skal Kunden udfylde en bestillingsblanket og sende den til Gucci via Webstedet. Kunden lægger Produktet i sin “indkøbskurv” og efter at have gennemlæst og godkendt disse Salgsbetingelser, især bestemmelserne om leveringsomkostninger og fortrydelsesret samt datapolitikken, vælges den ønskede betalingsmetode og ordren afgives.

5.3.

Hvis Kunden ønsker at korrigere eventuelle fejl i de indtastede data, følges den fremgangsmåde, der beskrives på Webstedet, inden bestillingen afsendes. Kunden kan for eksempel ændre det ønskede antal Produkter ved at tilføje eller fjerne et eller flere Produkter fra “indkøbskurven”.

5.4.

Ved afsendelse af en bestilling til Gucci erklærer Kunden, at denne har gjort sig bekendt med de under købsprocessen angivne anvisninger, og godkender fuldt disse Salgsbetingelser.

5.5.

Bestillingen samt Kundens oplysninger om den pågældende bestilling kan opbevares af Gucci i den periode, der kræves i henhold til gældende lovgivning, med forbehold af Kundens udtrykkelige samtykke samt bestemmelserne i datapolitikken.

6. Betaling

6.1.

Produkter og leveringsomkostninger kan betales med kreditkort eller ved bankoverførsel.

6.2.

Gucci tager følgende kreditkort:

6.3.

Betaling hæves på Kundens kreditkort når:

(i) Kreditkortoplysningerne er verificeret.

(ii) Kortudstederen har godkendt debitering på det af Kunden anvendte kreditkort, og

(iii) Gucci har bekræftet, at det ønskede Produkt er på lager, og at ordren derfor kan gennemføres.

6.4.

Der hæves således ikke på kreditkortet ved fremsendelse af bestillingen med undtagelse af eventuelle gebyrer for kontrol af kreditkort.

6.5.

Indbetaling til Gucci kan også foretages ved bankoverførsel til følgende IBAN-nr.: IT53 N030 5101 6990 0007 8389 018, BARCLAYS BANK PLC, BIC BARCITMMBKO. Omkostninger og udgifter (herunder bankgebyrer) i forbindelse med bankoverførsel faktureret af banken til Kunden, skal afholdes af Kunden.

6.6

Hvis det ikke er muligt at hæve et skyldigt beløb fra Kunden, stoppes transaktionen, og salget annulleres.

7. Indgåelse af aftale

7.1.

Aftalen mellem Gucci og Kunden er indgået på det tidspunkt, hvor Kunden modtager Guccis bekræftelse på at bestillingen, der er fremsendt i henhold til den på Webstedet beskrevne fremgangsmåde, er gennemført, og når det er kontrolleret, at Produktet er på lager, og købsprisen er debiteret på Kundens kreditkort, eller hvis betaling foregår ved bankoverførsel, når der er modtaget bekræftelse på modtagelse af bankoverførslen. Kundens bestilling er bindende for Gucci, når købsprocessen er gennemført på Webstedet uden fejl.

7.2.

Gucci forbeholder sig ret til delvist at gennemføre en bestilling, såfremt et eller flere af de bestilte Produkter ikke er på lager. I sådanne tilfælde debiteres kun et beløb svarende til den delvist gennemførte bestilling.

7.3.

Gucci hæfter ikke for fejl, der skyldes Kundens forbindelse til Webstedet.

7.4.

I henhold til Forbrugeraftalelovens § 12 skal Gucci sammen med ordrebekræftelsen eller ved indgåelse af aftalen sende en e-mail til Kunden med et sammendrag af Salgsbetingelserne samt oplysninger om de væsentligste produktkarakteristika for det indkøbte Produkt, en detaljeret angivelse af pris og betalingsmåde, leveringsomkostninger, betingelserne for udnyttelse af fortrydelsesretten, herunder information om at der for personaliserede Produkter ikke er fortrydelsesret, adresse til hvilken reklamationer kan sendes, information om supportydelser på eksisterende handelsvilkår. Kunden skal straks gennemgå denne meddelelse og uden unødigt ophold underrette Gucci om eventuelle fejl eller undladelser.

8. Ugyldig bestilling

8.1.

Uanset bestemmelserne i pkt. 7 ovenfor betragtes ingen bestilling som godkendt af Gucci, og en aftale betragtes ikke som indgået mellem Gucci og Kunden, hvis Gucci har rimelig anledning til at antage at Kunden:

(i) har til hensigt at indkøbe Produkterne i erhvervsmæssigt øjemed;

(ii) ikke handler i god tro, eller

(iii) forsøger at udnytte fortrydelsesretten på uretmæssig vis.

8.2.

I sådanne tilfælde er Kundens bestilling ugyldig og uden retsvirkning. Gucci skal pr. e-mail underrette Kunden om, at bestillingen ikke kan godkendes, og at der ikke kan indgås aftale. Endvidere skal Gucci annullere enhver debitering af Kundens konto.

9. Transport og levering

9.1.

Af sikkerhedsmæssige hensyn leveres Produkter indkøbt på Webstedet til den adresse, der er registeret for kreditkortet, medmindre Kunden anmoder om andet. Ved levering skal Kunden eller dennes repræsentant over 18 år kvittere for modtagelse. Gucci leverer ikke til postboks.

9.2.

Når indbetaling foretages ved bankoverførsel, afsendes varen når overførslen er modtaget og clearet af Gucci.

9.3.

Gucci fremsender faktura til køber for hver bestilling af Produkter pr. e-mail eller med almindelig post. Faktura udarbejdes på grundlag af de oplysninger, som Kunden har givet ved bestilling. Det er ikke muligt at ændre en faktura efter udstedelse.

9.4.

Leveringsomkostninger afholdes af Kunden og anføres særskilt på ordren og i faktura.

9.5.

Indkøb leveres af med kurer (f.eks. UPS Express) (herefter “Kureren”) mandag – fredag, ekskl. lørdag, søndag samt lokale eller nationale fridage, efter der er modtaget bekræftelse på godkendelse af bestillingen, dog forudsat at Produktet ikke er udsolgt. Gucci hæfter ikke for forsinkelser, som ikke kunne forudses, og/eller som udelukkende skyldes Kurerens forhold.

9.6.

Produkterne leveres, medmindre der opstår en force majeure situation eller anden uforudset begivenhed, i løbet af 30 dage efter indgåelse af aftalen, jf. pkt. 7.1 ovenfor, medmindre Gucci meddeler Kunden, herunder pr. e-mail, indenfor det samme tidsrum eller inden den sidste aftale leveringsdag, at de bestilte Produkter er udsolgt, herunder midlertidigt udsolgt. I sådanne tilfælde skal Gucci tilbagebetale eventuelle beløb indbetalt af Kunden i forbindelse med ordren.

9.7.

Hvis Kunden efter at have modtaget Guccis meddelelse om forsinket levering ønsker at annullere bestillingen, skal eventuelle beløb, der allerede er betalt af Kunden, tilbagebetales hurtigst muligt og under ingen omstændigheder senere en 30 dage efter modtagelsen af Kundens meddelelse om annullering af bestillingen, dog med undtagelse af personaliserede produkter, der er underlagt pkt. 12 nedenfor.

9.8.

Kunden eller dennes repræsentanter skal være til stede på den anførte leveringsadresse for at modtage levering af Produkterne. Efter levering af Produkterne skal Kunden kontrollere:

(i) at antallet af leverede produkter svarer til det antal, der er anført på følgesedlen, og

(ii) at emballagen er intakt, ubeskadiget, ikke våd eller på nogen måde ændret. Beskadigelse på emballage og/eller Produkt eller uoverensstemmelser mellem antallet af leverede produkter og dokumentationsmaterialet skal straks anføres skriftligt på Kurerens følgeseddel. Når Kurerens følgeseddel er underskrevet, og Kunden ikke har gjort indsigelser, er Kunden uberettiget til at gøre indsigelser over den fremsendte pakkes ydre stand.

10. Afsendelse og leveringsbekræftelse

10.1.

Gucci sender en e-mail til Kunden ved afsendelse af Produkterne, samt endnu en meddelelse når Produkterne er leveret.

11. Emballage

11.1.

Produkter indkøbt på Webstedet er emballeret på samme måde, som hvis Produktet var indkøbt i en Gucci-forretning.

12. Personaliserede produkter

12.1.

Med forbehold af nedenstående pkt. 15, gælder fortrydelsesret, returret eller retten til at annullere aftalen ikke for personaliserede produkter, f.eks. Produkter hvor Kundens initialer er indgraveret på Produktet. Kunden er indforstået med, at billeder på Webstedet ikke nødvendigvis er i overensstemmelse med realiteten: billeder og foto af indgravering viser ikke nødvendigvis det endelige produkts faktiske fremtoning.

13. Fortrydelsesret og annullering af ordrer

13.1.

Guccis mål er fuld tilfredshed for Kunden. I henhold til Forbrugeraftalelovens § 17 kan Kunden træde tilbage fra aftalen uden at anføre grund hertil ved by at returnere Produkter indkøbt på Webstedet i løbet af 14 dage efter modtagelse. Dette gælder alle Produkter med undtagelse af personaliserede produkter, der er omfattet af bestemmelserne i pkt. 12.

13.2.

Hvis Kunden ønsker at udnytte fortrydelsesretten, sendes nedenstående i en e-mail til assistance@dk-onlineshopping.gucci.com::

  • En meddelelse om Kundens ønske om at udnytte fortrydelsesretten i henhold til Forbrugeraftalelovens § 17.
  • Kunden skal anføre overfor hvilke Produkter denne ønsker at gøre fortrydelsesretten gældende.
  • Bestillingsnummer, og
  • Hvis Kunden har betalt for Produktet ved bankoverførsel, skal Kunden anføre det IBAN-nr, hvortil tilbagebetaling skal foretages.

13.3.

Når fortrydelsesretten udnyttes, skal Gucci tilbagebetale den fulde pris for Produktet, forudsat at dette returneres af Kunden i ubrugt, ubenyttet og ubeskadiget stand sammen med den relevante originalfaktura og original Gucci-emballage. Gucci accepterer udelukkende returnering og ombytning af Produkter, der er leveret med et retur-/byttemærke, såfremt ovenstående bestemmelser er opfyldt og mærket er intakt og vedhæftet Produktet.

13.4.

Gucci forbeholder sig ret til at afvise returvarer, der ikke opfylder disse betingelser. Bestemmelserne i pkt. 15 finder anvendelse på mangelfulde Produkter. Tilbagebetaling foretages ved hjælp af den samme betalingsmetode, der anvendtes ved indbetaling af købsprisen. Produkter indkøbt online kan ikke byttes og tages ikke retur i en Gucci-forretning. Produkter kan imidlertid byttes til andre Produkter i forretninger, der drives direkte af Gucci, med undtagelse af blandt andet outlet-forretninger, franchisetagere og afgiftsfri butikker og med forbehold af, at varen ikke er udsolgt.

13.5.

Kunden afholder omkostningerne til returnering af et Produkt. Eventuelle omkostninger afholdt af Kunden i forbindelse med returnering af Produkter refunderes ikke.

13.6.

Alle leveringer indeholder enkle anvisninger for returnering af Produkterne.

13.7.

Gucci skal i løbet af 30 dage efter modtagelse af Kundens meddelelse om annullering af en ordre eller modtagelse af returvarer tilbagebetale beløbet til Kunden.

13.8.

Gucci sender en e-mail til Kunden, når tilbagebetalingen er gennemført.

13.9.

Det anbefales, at Produkterne returneres med kurer, at de forsikres for den fulde værdi, og at der anvendes forsendelsessporing. Gucci hæfter ikke for returnerede Produkter, der ikke fremkommer til Gucci på grund af tab, tyveri eller beskadigelse, som ikke skyldes Gucci.

13.10.

Hvis en Kunde ønsker at ændre eller annullere en afgivet ordre, skal Kunden straks sende en e-mail til assistance@dk-onlineshopping.gucci.com. Denne e-mail skal være afsendt, inden Kunden modtager Guccis bekræftelse på, at Produkterne er afsendt.

13.11.

Gucci træffer enhver foranstaltning for at imødekomme Kundens anmodning. Orden kan ikke annulleres eller ændres, når først Produktet er afsendt. Fremsendte Produkter kan dog returneres i henhold til bestemmelserne i disse Salgsbetingelser.

14. Ombytning

14.1.

Gucci ombytter Produkter indkøbt på Webstedet.

14.2.

Produkter indkøbt på Webstedet ombyttes som beskrevet nedenfor.

14.3.

Hvis en Kunde finder, at der er uoverensstemmelse mellem det leverede og det bestilte skal al dokumentation vedrørende levering gemmes, og selve Produktet skal opbevares i originalemballagen. Kunden skal straks kontakte Gucci pr. e-mail på assistance@dk-onlineshopping.gucci.com som beskrevet i pkt. 13.

14.4.

Det Produkt, der ønskes ombyttet, skal fremsendes til Gucci i samme stand som ved levering i henhold til pkt. 13.3.

14.5.

Ved ombytning tilbagebetales det af Kunden betalte beløb, inden den nye transaktion kan gennemføres. Tilbagebetaling foretages ved hjælp af den samme betalingsmetode, der anvendtes ved indbetaling af købsprisen, jf. pkt. 6.

14.6.

Ved ombytning af et Produkt skal Kunden udfylde den formular, der fremsendes med hvert enkelt Produkt, og deri klart angive kodenr. og størrelse på det nye Produkt, som Kunden ønsker at modtage.

14.7.

Den nye ordre gennemføres kun, hvis den ønskede vare er på lager.

14.8.

Kunden afholder omkostningerne til returnering af et Produkt.

14.9.

Hvis Kunden ønsker ombytning på grund af mangler i henhold til pkt. 15, fremsendes den nye vare til Kunden med kurer uden yderligere leveringsomkostninger.

15. Reklamation

15.1.

Hvis et Produkt solgt af Gucci er behæftet med en fejl eller mangel, skal Kunden straks kontakte Online Support pr. e-mail til assistance@dk-onlineshopping.gucci.com, eller med almindelig post til følgende adresse:

15.2.

De rettigheder, Lov nr. 237 af 28 marts 2003 (”Købeloven”) gælder for salget af Produkterne. I henhold til loven er Kunden berettiget til gratis at få en mangel afhjulpet ved reparation eller omlevering, eller såfremt dette ikke er muligt, at få et passende prisnedslag, eller i tilfælde af væsentlig misligholdelse, at annullere aftalen. Disse rettigheder bortfalder, såfremt Kunden ikke underretter Gucci om en mangel i løbet af to måneder efter, at Kunden har konstateret denne mangel. Under alle retten til at påberåbe sig en mangel, der ikke forsætligt er forsøgt skjult af Gucci, udløber automatisk 26 måneder efter levering af Produkterne.

16. Fejl og mangler

16.1.

Gucci er forpligtet til at opdatere de afsnit på Webstedet med produktbeskrivelser og/eller -salg. Gucci kan dog ikke garantere et fejlfrit Websted. Webstedet kan indeholde trykfejl, unøjagtigheder eller undladelser, f.eks. i relation til produktpris, produkttilgængelighed eller produktbeskrivelse. Gucci forbeholder sig ret til at korrigere sådanne fejl, unøjagtigheder eller undladelser, også efter afsendelse af en ordre, og forbeholder sig også ret til at ændre eller opdatere information til enhver tid uden forudgående varsel.

17. Ægthedsgaranti og immaterielle rettigheder

17.1.

Gucci garanterer ægtheden af Produkter indkøbt på Webstedet. Produkter med et Gucci-varemærke er fremstillet af håndværkere i Italien og lavet af de bedste materialer. Det gælder dog ikke ure, der er fremstillet i Schweiz, og parfumevarer der er fremstillet i Frankrig.

17.2.

“Gucci”-varemærket sammen med figurmærker og ikke-figur mærker, servicemærker på Produkterne, det relevante tilbehør og/eller emballage, registrerede mærker vedrørende udformning, illustrationer, billeder og steder beskyttet ved ophavsret og mere generelt enhver immateriel rettighed til Produkterne tilhører selskaberne i Guccio Gucci S.p.A og Gucci America Inc., selskaberne i PPR Luxury-koncernen.

18. Lovvalg og værneting

18.1.

Disse Salgsbetingelser er underlagt dansk ret og fortolkes i overensstemmelse med dansk ret.

18.2.

Eventuelle tvister, der måtte udspringe på grundlag af fortolkningen, gyldigheden og/eller gennemførelsen af disse Salgsbetingelser, skal afgøres ved Kundens/forbrugerens værneting.
