1.1
The present site www.gucci.com (hereinafter Site) is owned by Gucci and is operated by G Commerce SpA, a company which is part of Gucci Group, with the registered address in Scandicci (Italia) Via Don Lorenzo Perosi 6, VAT 5142860484, (hereinafter G Commerce-Gucci);
1.2
The present general terms and conditions (hereinafter Terms and Conditions) regulate the relationship between the Customer (hereinafter the Customer) and G Commerce (hereinafter referred to as Parties) for the purchase of the Gucci products (hereinafter Products) from time to time available on the Site.
The following purchase agreement may be entered in the following language: English.
1.3
Access to the online boutique is permitted exclusively to the Customers, as defined below, who reside in Belgium. For the purpose of the present Terms and Conditions, by Customer, we refer exclusively to the consumer, in any case to a person that purchases the products for non professional or business purposes.
1.4
The Customer is requested to read carefully the general terms and conditions of the present Terms and Conditions that are made available on the Site, in order to allow the Customer to print and save these Terms and Conditions for future reference pursuant to the previsions of article 12 of the Dlgs. N.70 enacted on April 9th 2003. A copy of the following Terms and Conditions will be provided by Gucci to the Customer, via e-mail pursuant to the prevision of the following paragraph. 5.4 of the present Terms and Conditions.

All the purchase agreements entered with G Commerce by accessing the Site are governed by the Italian law, pursuant to the previsions of the DL. N. 206 enacted on September 6 2005 (Consumers Code) and the Dlgsv. n. 70 of April 9th 2003 (in accordance with the EEC directive 200/31/CE).
2.0 Product Availability
2.1
The Products available for purchase online are: handbags, shoes, small leather goods, luggage, jewelry, watches, sunglasses, gifts and fragrance.
All the Products are subject to the availability at the time of the order.
Gucci reserves the right to vary at any time the quantity and/or the type of products that may be purchased on the Site. The Customer will be informed if the Product requested is not available.
3.0 Pricing
3.1
All prices on the Site are stated in Euro and GBP for the UK they include any Vat and applicable taxes. The prices are not comprehensive of the shipping and delivery charges.
3.2
Gucci tries to ensure that all pricing information on the Site is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a Product shall occur, Gucci will allow the Customer the option to confirm the purchase of the Product at the correct price or to cancel the order. If Gucci is unable to contact the customer the order will be treated as cancelled.
3.3
The ownership of the Product purchased on the Site will be transferred to Customer at the moment of the delivery on condition that Gucci has received the payment for the entire value of the goods. In any event the risks of damages and/or loss of the Product are transferred to the Customer at the time of the delivery.
4.0 Ordering a Product
4.1
The details and the price of the Product are detailed in the single page of each Product listed on the Site.
4.2
To purchase the chosen Product the Customer shall complete, following the instruction indicated on the Site, and send to G Commerce, the online purchase form. The Customer shall add the Product to the "shopping bag" and after having reviewed and accepted the shipping expenses, the Terms and Conditions and the general cancellation policy. The Customer shall then choose the manner in which he/she wishes to pay and the shall proceed to the option "purchase/buy".
4.3
Shall the Customer need to amend or modify the data inserted in the order placed, Customer shall follow the proper procedure for the amending of the order as indicated in the Site before submitting the order. Moreover the Customer may amend or modify the number of Products he/she wishes to purchase, adding or deleting one or more Products from the shopping bag.
5.0 Purchase Agreement
5.1
The purchase agreement entered by and between Gucci and the Customer shall be considered completed and duly entered by the Parties at the time in which the order is duly submitted by the Customer - in accordance with the purchase procedure indicated on the Site and after that Gucci has received the authorization from the credit card issuer that the payment is accepted.
The order submitted by the Customer shall be binding for Gucci only if the entire purchase procedure has been duly and correctly completed without error and without any detection of error by the site. Gucci is not responsible for any eventual errors caused by the technical malfunctioning of the Customer’s internet connection service.
5.2
By submitting the order to Gucci the Customer acknowledges and states that he/she has reviewed and accepted all the indications provided in the purchasing procedure and he/she entirely accepts the present Terms and Conditions.
5.3
The online order form will be stored in the Sites database for the time necessary for the fulfillment of the order.
5.4
Gucci will send to the Customer an e-mail confirming the receipt of the order placed by the Customer; a summary of the Terms and Conditions, Privacy Policy and any special previsions that may apply to the agreement; the information relating to Gucci: a summary of the Product(s) ordered; the details of the products purchased; the time and date of the purchase; the details of Gucci to which the Customer may send the eventual complaints.
the commercial warranties; the terms for the withdrawal from the present purchase agreement, the formalities and the timing for the return of the Products, the payment modality chosen by the Customer, the prices of the Product(s), the shipping expenses. The Customer shall immediately verify the content of the e-mail and shall notify immediately Gucci of any error or other mistake.
6.0 Payment
6.1
The Customer may pay for the Products and the shipping expenses by credit card. Gucci accepts the following credit cards:

The transaction will be charged to the Customer’s credit card only once the credit card data has been verified; and only after that Gucci has received the debiting authorization from the credit card issuer and Product availability has been verified by Gucci. The Customer’s credit card will be charged only once the order is ready to be shipped.
The card will not be charged at the time of the submitting of the order.
7.0 Shipping and Delivery
7.1
For security reasons the Product(s) purchased on the Site will be sent to the registered address on the credit card.
At the time of delivery an adult of over 18 years of age shall be present to sign the delivery documents.
Delivery cannot be made to P.O. Boxes and these orders will not be processed.
7.2
For each order completed on Site, Gucci, will issue an invoice for the shipped Products, sending it via e-mail or registered mail to the Customer, in accordance with the prevision of the D.P.R. 445/2000 and D.L. 52/2004. For the issuance of the invoice Gucci will refer to the data provided by the Customer. Once the invoice has been issued no modification of the same will be possible.
7.3
The shipping and delivery expenses are to be borne by the Customer and are clearly indicated in the online form. The shipping and delivery expenses may vary depending on location and on the type of shipment requested (i.e. express overnight etc.)
7.4
All the Products will be shipped via UPS or other courier (hereinafter Courier) which will be dispatched the next working day following the confirmed availability and charge of the order. The order will be dispatched between Monday to Friday, excluding local and national holidays and festivities. Gucci is not responsible for unpredictable delays, notwithstanding that, except for cases of Force Majure, the Product(s) will be delivered within a maximum of thirty (30) days following the day after the submission to Gucci of the order by the Customer. Unless otherwise specified by the wait time indicated on the order.
7.5
For the delivery of the Products the Customer or a person authorized by the latter shall be present at the address indicated in the order. At the time of the delivery by the Courier, the Customer shall verify:
(i) that the number of the boxes are same as reported on the transportation documents (DDT);
(ii) that the packaging is not damaged, or wet or in another way tampered with. Any damage in the packaging and/or in the Product(s) or any discrepancy between the number of the boxes actually delivered and the number of the boxes indicated on the transportation document, shall be immediately notified by indicating it in writing on the Courier’s delivery documents. Once the Customer has signed the Courier’s transportation document, the Customer may not oppose objection on the external characteristic of the delivered goods.
7.6
In the event that, due to sudden and temporary unavailability of the Products, Gucci shall be unable to deliver the goods, Gucci shall promptly inform the Customer, and in any way within thirty (30) days via e-mail.
The amount paid by the Customer shall be refunded as quickly as possible and in any case within thirty (30) days from the receipt of the order submitted by Customer.
8.0 Tracking number
8.1
Once the Product(s) have been sent Gucci will send an e-mail to the Customer. Furthermore, Gucci will send to the Customer a confirmation of the delivery once Gucci has received from the Courier the notification of the delivery.
8.2
In order to guarantee the security of the delivery of the Products Gucci will not provide the Customer with the tracking number, but Gucci will keep the tracking number of each delivery.
9.0 Returns and cancellations
9.1
Gucci wishes to guarantee the complete satisfaction of the Customer. Gucci will refund the entire cost of the Product(s) that are returned by the Customer not worn, not used and not damaged and accompanied by relevant the invoice.
Certain items are shipped with a return/exchange tag attached. Returns and exchanges on these specific items will only be honored if the label remains intact and the return instructions above are followed.
The refunds will be issued in the same form as was utilized for payment.
The purchased goods may be returned within maximum 15 (fifteen) days from the delivery date.
The Products purchased online cannot be refunded nor returned in the outlet stores.
The delivery cost are not refundable.
9.2
All the delivery expenses for the return of the Products shall be borne by the Customer: each and any cost borne by the Customer for the return is not refundable.
9.3
Gucci reserves the right to refuse the return of those Products that do conform to the provision of the above paragraph 9.1.
9.4
Each delivery contains easy to follow instructions for the return of the Products. Gucci will make every effort to promptly refund the Customer within and no longer than (30) thirty days from the written order cancellation request and receipt of the returned goods as per paragraph 9.1
Once the refund has been completed Gucci will send a confirmation e-mail.
9.5
Gucci recommends to use a courier for the return of the Product(s) in order to allow the tracking of the shipment.
Gucci will not be held responsible for the refund or the compensation of those Products that have been lost, stolen or damaged.
9.6
Pursuant to the provisions of article 64 of the D. lgs n. 206/2005, the Customer has the right to withdraw from the agreement without any penalty and without specifying the reason within the term of 15 (fifteen) working days from the receipt of the Products, save the provisions of following paragraph 9.7
9.7
The Customer may withdraw from the present agreement and shall send a written notification to the following address: assistance@be-onlineshopping.gucci.com
the written communication with return receipt shall contain:
the express will of the Customer to avail himself of the right to withdraw from the agreement pursuant to the provision of article 64 of the D. lgs n. 206/2005;
the details of the Products in relation to which the Customer wishes to withdrawal;
the order number issued at the time of the purchase.
The above notification may be sent within the above stated period of 15 (fifteen) working days also via telegram, telex, fax with the only condition that the notification be sent via registered mail with return receipt within the following 48 hours.
9.8
Shall the Customer decide to modify or delete the submitted order, the Customer shall promptly send an e-mail at the following address:

Gucci will use its best endeavors to satisfy the Customer. Moreover once the product has been sent the order may no longer be modified nor deleted until the Products has been duly returned to Gucci. To this extent please refer to the provision of the above paragraph 9.1.
10.0 Exchanges
10.1
The exchange of an item purchased the Site, involves an easy two step process. First, please begin by making an online selection to identify and to purchase the replacement item. Second, return the original item by following the steps outlined in the previous section. Please note that the returned item must be received by Gucci in original condition and that new orders are subject to Gucci having available merchandise on-hand. Shipping charges for any returned item(s) are the client’s responsibility. Please contact Gucci at: assistance@be-onlineshopping.gucci.com to ensure that you do not incur an additional shipping fee on the replacement item. Your exchange item(s) will be sent to you via UPS at no additional cost.

In accordance with the provisions of Article 47, §4, 2° of the Act of 6 April 2010 on Market Practices and Consumer Protection, the right of withdrawal, to cancel or return does not apply to orders for customised products such as, for example, those with the client’s initials engraved on the product. The client is aware that the image shown on the website does not necessarily correspond to reality: images and photographs of the engraving may not reflect the actual appearance of the final product.
11.0 Gift wrapping
11.1
The Products purchased on the Site are delivered in gift boxes. The Products are wrapped in tissue paper and are enclosed in a gift box bearing the Gucci logo.
The box is wrapped with a silk ribbon.
The Gucci gift boxes are generally available for Products of the dimension 46x46x20 cm or smaller. For larger Products, a special Gucci gift box will be included in the delivery.
12.0 Errors and mistakes
12.1
Gucci uses it’s best endeavors in order to keep the information on the Site constantly updated.
Moreover it is not possible to guarantee the complete absence of errors on the Site. The Site might carry typo’s, errors, inaccuracies some of which may refer to the price of the Product, to the product availability and/or to the details of the Products.
Gucci reserves the right to amend the errors and inaccuracies also after that the order has been submitted and furthermore reserves the right amend or modify the information on the Site at any time without prior communication.
13.0 Guarantee of Authenticity
13.1
Gucci guarantee the authenticity of all the Products purchased on the Site. The Products marked Gucci are crafted with the best materials and are made by the best craftsmen. All the Products are made in Italy, with the sole exception of the timepieces which are made in Switzerland.
13.2
The original Gucci Products are sold on the internet exclusively through the site www.gucci.com. All the intellectual property rights such as, trademarks, service trademarks, marks and copyrights are exclusive property of Gucci. No page or other content of the Site may be reproduced without the prior written approval of Gucci.
14.0 Defects
14.1
Shall a Product purchased from G-Commerce show a defect, the Customer shall immediately contact the customer care at the following address:

14.2
Shall the Customer be unsatisfied and/or for any discrepancy with the order submitted by the Customer, the Customer shall keep all the papers, the Product and its box and contact immediately the company via e-mail at the following address: assistance@be-onlineshopping.gucci.com.
15.0 Applicable law and jurisdiction
15.1
The terms and condition for the access to the Site are regulated by the Italian law and shall be interpreted in pursuance to the Italian laws.
15.2
The Customer accept the non exclusive jurisdiction of the Italian courts. For any controversy arising from or in connection to the navigation or the use of the Site the competent court shall be the court of Florence.

1.0 Algemene voorkennis
1.1
De site www.gucci.com (hierna “site” genoemd) is eigendom van Gucci en wordt beheerd door G Commerce SpA, een bedrijf dat deel uitmaakt van de Gucci Groep, met maatschappelijke zetel in Firenze (Italië), Via Don Lorenzo Perosi 6, BTW-nummer 5142860484 (hierna “G Commerce-Gucci” genoemd).
1.2
De onderhavige algemene voorwaarden (hierna “voorwaarden” genoemd) regelen de relatie tussen de klant (hierna de “klant” genoemd) en G Commerce (hierna gezamenlijk de “partijen” genoemd) met betrekking tot de aankoop van de Gucci producten (hierna “producten” genoemd) die nu en dan op de site worden aangeboden.
Onderstaande koopovereenkomst kan worden gesloten in de volgende talen: Engels en Nederlands.
1.3
Toegang tot de online-boetiek wordt uitsluitend verleend aan klanten, zoals verder bepaald, die in Nederland wonen. Met het oog op deze voorwaarden refereren we met “klant” uitsluitend aan de verbruiker en in elk geval aan een persoon die de producten koopt voor niet-professionele of handelsdoeleinden.
1.4
De klant wordt verzocht om de algemene bepalingen van de onderhavige voorwaarden die op de site kunnen worden geraadpleegd, zorgvuldig te lezen zodat hij deze voorwaarden kan uitprinten en bewaren voor latere referenties in overeenstemming met de voorschriften van artikel 12 Dlgs. N.70 van 9 april 2003. Gucci stelt een kopie van onderstaande voorwaarden via e-mail ter beschikking van de klant op grond van de bepaling van onderstaande paragraaf 5.4 van onderhavige voorwaarden.

Alle koopovereenkomsten die met G Commerce worden aangegaan via de site, zijn onderworpen aan de Italiaanse wetgeving krachtens de bepalingen van DL. N. 206 van 6 september 2005 (gedragscode voor consumenten) en van Dlgsv. n. 70 van 9 april 2003 (in overeenstemming met EG-richtlijn 200/31/EG).
2.0 Productbeschikbaarheid
De producten die online kunnen worden gekocht, zijn: handtassen, schoenen, kleine lederwaren, bagage, juwelen, horloges, zonnebrillen, geschenken en parfum.
Alle producten worden geleverd volgens de beschikbaarheid op het moment van de bestelling.
Gucci behoudt zich het recht voor om de hoeveelheid en/of het aanbod van de producten die via de site kunnen worden gekocht om het even wanneer te wijzigen.
De klant wordt gewaarschuwd indien het gevraagde product niet beschikbaar is.
3.0 Prijzen
Alle prijzen op de site zijn uitgedrukt in euro en in GBP voor Groot-Brittannië en zijn inclusief BTW en de van toepassing zijnde belastingen. In de prijzen zijn de verzend- en leveringskosten niet inbegrepen.
3.2
Gucci spant zich optimaal in opdat alle prijsinformatie op de site correct zou zijn, maar kan niet garanderen dat er geen enkele fout in voorkomt. In het geval dat de prijs van een product foutief is, biedt Gucci de klant de mogelijkheid om de bestelling van het product tegen de correcte prijs te bevestigen of de bestelling te annuleren. Indien Gucci er niet in slaagt de klant te contacteren, wordt de bestelling als geannuleerd beschouwd.
3.3
De eigendom van het via de site gekochte product wordt aan de klant overgedragen bij de levering op voorwaarde dat Gucci de integrale betaling van de goederen heeft ontvangen. De risico’s op schade aan of verlies van het product worden op het moment van de levering aan de klant overgedragen.
4.0 Product bestellen
4.1
De bijzonderheden en de prijs van het product zijn omstandig vermeld op de pagina die is voorbehouden aan elk product dat op de site is opgenomen.
4.2
Om het gekozen product te kopen, dient de klant volgens de op de site vermelde aanwijzingen het online-koopformulier in te vullen en naar G Commerce te verzenden. De klant voegt het product toe aan zijn “winkelmandje” na kennisname en aanvaarding van de verzendingskosten, de voorwaarden en het algemene annuleringsbeleid. De klant bepaalt vervolgens de manier waarop hij/zij wenst te betalen en gaat dan verder met de optie “kopen” aan te klikken.
4.3
Indien de klant verbeteringen of wijzigingen aan de gegevens in de opgegeven bestelling dient aan te brengen, moet hij daarvoor de juiste, op de site vermelde procedure voor het rectificeren van de bestelling volgen, en dit voor hij de bestelling doorgeeft. De klant kan bovendien het aantal producten dat hij/zij wenst te kopen verbeteren of wijzigingen door een of meerdere producten aan het winkelmandje toe te voegen of te schrappen.
5.0 Koopovereenkomst
5.1
5.1
De koopovereenkomst die tussen en door Gucci en de klant wordt aangegaan, wordt beschouwd als gesloten en door de partijen behoorlijk aangegaan op het moment waarop de klant de bestelling behoorlijk doorgeeft – in overeenstemming met de op de site vermelde koopprocedure en nadat Gucci van de credit card uitgever de goedkeuring heeft ontvangen dat de betaling is aanvaard.
De door de klant doorgegeven bestelling is voor Gucci alleen bindend indien de volledige koopprocedure behoorlijk en correct is gevolgd zonder dat er op de site enige fout is vastgesteld. Gucci is niet verantwoordelijk voor eventuele fouten, veroorzaakt door een technische storing in de internetverbinding van de klant.
5.2
Door zijn/haar bestelling aan Gucci door te geven erkent en bevestigt de klant dat hij/zij kennis heeft genomen van de aanwijzingen in de koopprocedure, dat hij/zij deze heeft aanvaard en dat hij/zij volledig instemt met de onderhavige voorwaarden.
5.3
Het online-bestelformulier wordt in de database van de site opgeslagen tot de bestelling volledig is afgehandeld.
5.4
Gucci stuurt de klant een e-mail waarin de ontvangst van de door de klant geplaatste bestelling wordt bevestigd. Deze e-mail bevat contactgegevens in verband met Gucci: een overzicht van de bestelde producten, de bijzonderheden van de bestelde producten, het tijdstip en de datum van de bestelling, de prijs van de producten, de verzendkosten en de door de klant gekozen betaalwijze. Aanwijzingen over de manier waarop het koopbeleid dient te worden geïnterpreteerd, een samenvatting van de voorwaarden en van het privacybeleid zijn eveneens op de site opgenomen.
De klant dient de inhoud van de e-mail onmiddellijk te controleren en dient Gucci onverwijld in kennis te stellen van eventuele fouten of andere vergissingen.
6.0 Betaling
6.1
TDe klant kan de producten en verzendkosten vereffenen met behulp van een credit card. Gucci aanvaardt volgende credit cards:

De transactie wordt slechts van de credit card van de klant gedebiteerd na verificatie van de credit card en alleen nadat Gucci van de credit card uitgever de goedkeuring tot debiteren heeft ontvangen en Gucci heeft gecontroleerd of het product beschikbaar is. De credit card van de klant wordt slechts gedebiteerd wanneer de bestelling verzendklaar is.
De kaart wordt niet gedebiteerd op het moment dat de bestelling wordt doorgegeven.
7.0 Verzending en levering
7.1
Om veiligheidsredenen worden de via de site gekochte producten verzonden naar het op de credit card vermelde adres.
Bij de levering dient een volwassene, ouder dan 18 jaar, aanwezig te zijn om de leveringsdocumenten te ondertekenen.
Leveringen kunnen niet worden bezorgd op postbusadressen; dergelijke bestellingen worden niet behandeld.
7.2
Gucci stelt voor elke bestelling die via de site is gedaan een rekening op voor de verzonden producten en bezorgt deze via e-mail of bij aangetekend schrijven aan de klant in overeenstemming met de bepaling van D.P.R. 445/2000 en D.L. 52/2004. Voor de uitgifte van de rekening verwijst Gucci naar de gegevens die de klant heeft verstrekt. Van zodra de rekening is uitgegeven, kunnen er geen wijzigingen meer aan worden aangebracht.
7.3
De verzend- en leveringskosten zijn voor rekening van de klant en staan duidelijk op het online-formulier vermeld. De verzend- en leveringskosten kunnen schommelen naargelang van de plaats en van de aard van de gevraagde verzendingswijze (vb. express overnight, enz.).
7.4
Alle producten worden verstuurd via UPS of een ander koerierbedrijf (hierna “koerierbedrijf” genoemd) en worden verzonden de werkdag na de dag waarop de beschikbaarheid van het product is bevestigd en het bedrag van de bestelling is gedebiteerd. De bestelling wordt verstuurd tussen maandag en vrijdag, met uitzondering van plaatselijke en nationale vrije dagen en feestdagen. Gucci kan niet aansprakelijk worden gehouden voor onvoorspelbare vertragingen, niettegenstaande dat de producten, uitgezonderd in geval van overmacht, worden geleverd binnen een termijn van maximum dertig (30) dagen nadat de klant zijn/haar bestelling aan Gucci heeft doorgegeven. Tenzij anders is aangegeven door de op de bestelling vermelde wachttijd.
7.5
Voor de levering van de producten dient de klant of een door hem/haar gemachtigde persoon aanwezig te zijn op het adres dat op de bestelling is vermeld. Wanneer het koerierbedrijf de levering aanbiedt, dient de klant te verifiëren:
(i) dat het aantal dozen gelijk is aan het op de transportdocumenten (DDT) vermelde aantal;
(ii) dat de verpakking niet beschadigd of nat is of andere schade vertoont. Alle schade aan de verpakking of aan de producten of iedere afwijking tussen het aantal werkelijk geleverde dozen en het aantal dozen, vermeld op het transportdocument, moet onmiddellijk worden gemeld middels een schriftelijke aantekening op de leveringsdocumenten van het koerierbedrijf. Eens de klant het transportdocument van het koerierbedrijf heeft ondertekend, kan hij geen bezwaar meer indienen wat de externe kenmerken van de geleverde goederen betreft.
7.6
In het geval dat Gucci wegens plotse en tijdelijke niet-beschikbaarheid van de producten niet in staat is de goederen te leveren, stelt Gucci de klant hiervan onverwijld en in elk geval binnen dertig (30) dagen via e-mail op de hoogte.
Het door de klant betaalde bedrag dient zo snel mogelijk en in elk geval binnen dertig (30) dagen na ontvangst van de door de klant doorgegeven bestelling te worden terugbetaald.
8.0 Traceerbaarheidsnummer
8.1
Van zodra de producten zijn verstuurd, verwittigt Gucci de klant hiervan via e-mail. Gucci stuurt de klant bovendien een bevestiging van de levering van zodra Gucci van het koerierbedrijf het bericht van levering heeft ontvangen.
8.2
Om de veiligheid van de levering van de producten te kunnen garanderen stelt Gucci de klant niet in kennis van het traceerbaarheidsnummer, maar houdt het traceerbaarheidsnummer van elke levering bij.
9.0 Retourneren en annuleren
9.1
Gucci wenst de volledige tevredenheid van de klant te garanderen.
Gucci betaalt alle kosten, verbonden aan de door de klant geretourneerde niet- gedragen, niet-gebruikte en onbeschadigde producten die vergezeld zijn van de relevante rekening, terug.
Bepaalde producten worden gestuurd met een retour/ruilingslabel eraan bevestigd. Retouren en ruilingen van deze specifieke producten zullen alleen worden behandeld als het label onbeschadigd is en de ruilingsinstructies, hierboven genoemd, worden gevolgd.
De terugbetalingen gebeuren in dezelfde vorm als gebruikt voor de betalingen.
De gekochte goederen kunnen binnen maximum vijftien (15) dagen na de leveringsdatum worden geretourneerd.
De online gekochte producten kunnen niet in verkooppunten worden terugbetaald of geretourneerd.
De leveringskosten worden niet terugbetaald.
9.2
Alle leveringskosten voor het retourneren van de producten zijn voor rekening van de klant; de kosten die de klant in verband met het retourneren van de producten maakt, worden niet terugbetaald.
9.3
Gucci behoudt zich het recht voor geretourneerde goederen die niet in overeenstemming zijn met de bepaling van bovenvermelde paragraaf 9.1, te weigeren.
9.4
Elke levering bevat gemakkelijk te volgen aanwijzingen om de producten te retourneren.
Gucci verplicht zich ertoe de klant stipt binnen dertig (30) dagen na het verzoek om de schriftelijke bestelling te annuleren en na ontvangst van de goederen terug te betalen.
Van zodra de terugbetaling is uitgevoerd, stuurt Gucci een e-mail ter bevestiging.
9.5
Gucci adviseert om voor het retourneren van de producten een koerierbedrijf in te schakelen om het traject van de zending te kunnen opvolgen.
Gucci kan niet aansprakelijk worden gesteld voor de terugbetaling of vergoeding van producten die verloren zijn gegaan, werden gestolen of beschadigd.
9.6
Op grond van de bepalingen van artikel 64 D. lgs n. 206/2005 heeft de klant het recht om zich zonder enige boete en zonder opgave van redenen uit de overeenkomst terug te trekken binnen een termijn van vijftien (15) werkdagen na ontvangst van de producten, behoudens de bepalingen van onderstaande paragraaf 9.7.
9.7
De klant mag zich uit onderhavige overeenkomst terugtrekken en dient hiervan een schriftelijke kennisgeving te bezorgen op volgend adres:

de uitdrukkelijke wens van de klant om zijn recht om zich terug te trekken uit de overeenkomst uit te oefenen op grond van de bepaling van artikel 64 D. lgs n. 206/2005;
de bijzonderheden van de producten in verband waarmee de klant zich wenst terug te trekken;
het ordernummer dat op het moment van de koop werd toegekend.
Bovenvermelde kennisgeving kan binnen de bovenvermelde termijn van vijftien (15) werkdagen ook per telegram, telex, fax worden verstuurd met als enige voorwaarde dat de kennisgeving bij aangetekend schrijven met retourbewijs binnen de daaropvolgende 48 uur wordt verstuurd.
9.8
Indien de klant besluit om de doorgegeven bestelling te wijzigen of te annuleren, dient hij onverwijld een e-mail te sturen naar volgend adres:

Gucci doet al het mogelijke om de klant tevreden te stellen. Van zodra het product is verstuurd, kan de bestelling niet meer worden gewijzigd of geannuleerd tot de producten behoorlijk aan Gucci zijn geretourneerd. Gelieve in verband hiermee de bepaling van bovenstaande paragraaf 9.2 te raadplegen.
10.0 Ruilen
10.1
Het ruilen van een op de site gekocht product verloopt in twee, gemakkelijke stappen. Eerste stap: maak een online-selectie om het vervangingsartikel te identificeren en te kopen. Tweede stap: retourneer het oorspronkelijke artikel en volg daarvoor de in vorig artikel beschreven procedure. Gelieve er rekening mee te houden dat het geretourneerde artikel bij Gucci moet toekomen in de oorspronkelijke staat en dat nieuwe bestellingen onderworpen zijn aan de voorwaarde dat de goederen bij Gucci beschikbaar zijn. De verzendkosten voor geretourneerde artikelen zijn voor rekening van de klant. Gelieve Gucci te contacteren via assistance@be-onlineshopping.gucci.com om u ervan te verzekeren dat u geen bijkomende verzendkosten voor het vervangingsartikel dient te betalen. De door u geruilde producten worden via UPS zonder meerkost verstuurd.
Verpersoonlijking
Conform de bepalingen van artikel 47, §4, 2° van de wet van 6 april 2010 betreffende de marktpraktijken en de bescherming van de consument, kan de klant het herroepingsrecht niet uitoefenen voor bestellingen van Producten die een persoonlijk karakter hebben, bijvoorbeeld doordat de initialen van de klant op het Product gegraveerd zijn. De klant is zich bewust van het feit dat de grafische afbeelding voorgesteld op de website niet noodzakelijkerwijze met de werkelijkheid overeenstemt: het is mogelijk dat de afbeeldingen en foto’s van de gravure het werkelijke aanzicht van het eindeproduct niet weerspiegelen.
11.0 Geschenkverpakking
11.1
De producten die via de site worden gekocht, worden in geschenkdozen geleverd. De producten zijn in zijdepapier gewikkeld en verpakt in een geschenkdoos met Gucci logo.
De doos is voorzien van een zijden lint.
De Gucci geschenkdozen zijn in het algemeen beschikbaar voor producten van 46x46x20 cm of kleiner. Voor grotere producten wordt een speciale Gucci geschenkdoos meegeleverd.
12.0 Fouten en vergissingen
12.1
Gucci stelt alles in het werk om de informatie op de site voortdurend up-to-date te houden.
Gucci kan evenwel onmogelijk garanderen dat de site absoluut foutloos is. Mogelijk zijn er tikfouten, vergissingen, onnauwkeurigheden in de site geslopen waarvan sommige betrekking kunnen hebben op de prijs van het product, de productbeschikbaarheid en/of de bijzonderheden van het producten.
Gucci behoudt zich het recht voor de fouten en onnauwkeurigheden recht te zetten, ook nadat de bestelling is doorgegeven en behoudt zich verder het recht voor de informatie op de site op gelijk welk moment en zonder voorafgaande kennisgeving te verbeteren of te wijzigen.
13.0 Authenticiteitsgarantie
13.1
Gucci staat garant voor de authenticiteit van alle producten die via de site worden gekocht. Producten die het Gucci label dragen, zijn vervaardigd van de beste materialen en door de beste ambachtslui.
Alle producten zijn in Italië geproduceerd, met als enige uitzondering de horloges die in Zwitserland zijn gemaakt.
13.2
De originele Gucci producten worden exclusief op het internet verkocht via de site www.gucci.com. Alle rechten van intellectuele eigendom zoals handelsmerken, dienstverleningsmerken, merken en copyrights zijn exclusieve eigendom van Gucci. Geen enkele pagina of andere inhoud van de site mag worden gereproduceerd zonder de voorafgaande schriftelijke toestemming van Gucci.
14.0 Gebreken

Indien een bij Gucci gekocht product een gebrek vertoont, dient de klant onmiddellijk contact op te nemen met de klantendienst op onderstaand adres:

15.0 Toepasbare wetgeving en rechtsbevoegdheid

De voorwaarden om toegang te verkrijgen tot de site, zijn onderworpen aan de Italiaanse wetgeving en dienen te worden geïnterpreteerd in overeenstemming met de Italiaanse wetten.
15.2
De klant stemt in met de niet-exclusieve rechtsbevoegdheid van de Italiaanse rechtbanken. Bij een geschil, voortvloeiend uit of in verband met het navigeren door of het gebruikmaken van de site, is alleen de rechtbank van Firenze bevoegd om een uitspraak te doen.

1.0 Dispositions Générales
1.1
Le site www.gucci.com (ci-après, “Site”) appartient à Gucci et est exploité par G Commerce Europe S.p.A., société faisant partie du Groupe Gucci dont le siège social est situé à Florence (ITALIE) Via Don Lorenzo Perosi 6, N° TVA 5142860484, code fiscal 00338740343 (ci-après, “G Commerce o Gucci”).

Les conditions générales de ce contrat (ci-après, “Conditions Générales”) régissent les relations entre le client (ci-après, “Client”) et G Commerce (ensemble, ci-après, “Parties”) pour l'achat des produits Gucci (ci-après “Produits”) mis en disposition sur le Site. La langue mises à disposition pour la conclusion du contrat est le français.

L'accès à la vente par l'intermédiaire du Site est exclusivement réservé aux clients, tels que définis ci-après, résidant en France. Aux fins des présentes Conditions générales, Client désigne uniquement le consommateur, ou une personne physique qui acquiert la marchandise autrement que pour l’exercice éventuel d’une activité professionnelle.

Le Client est tenu de lire attentivement les termes et conditions des Conditions générales qui ont été mises à sa disposition sur le Site, afin qu'il puisse les mémoriser et les reproduire aux termes de l'article 12 du D. Lgs. n° 70 du 9 avril 2003. G Commerce expédiera au Client un exemplaire des Conditions générales, par courrier électronique,, conformément à l'article 5.4 des Présentes conditions générales.

Les contrats conclus par G Commerce en accédant au Site, sont régis par le droit italien et, en particulier, par le D. Lgs n° 206 du 6 septembre 2005 (Code de la Consommation) et par le D. Lgs n° 70 du 9 avril 2003 (Application de la Directive 2000/31/CE relative à certains aspects juridiques des services de la société d'information dans le marché intérieur, notamment en ce qui concerne le commerce électronique).
2.0 Disponibilité du produit
2.1
Les Produits disponibles pour l'achat en ligne sont les sacs, chaussures, petite maroquinerie, bagages, bijouterie, montres, lunettes de soleil , cadeaux et parfums.
Tous les produits sont soumis à la disponibilitéau moment de la commande. Gucci se réserve le droit de modifier à tout moment les quantités et/ou la nature des marchandises pouvant être achetées en ligne sur le Site.
Gucci informera le Client si sa commande ne peut être traitée du fait de l’indisponibilité du produit commandé.
3.0 Prix
3.1
Le prix des Produits est exprimés sur le Site en € (Euros) et pour l'Angleterre en GBP et s'entend taxes ou impôts applicables compris. Les frais d’envoi sont exclus.
3.2
Gucci vérifie constamment que tous les prix indiqués sur le site sont corrects, sans toutefois pouvoir garantir l'absence absolue d'erreurs. Si une erreur dans le prix d’un article devait se produire, Gucci donnera au Client la possibilité de reconfirmer l'achat du Produit au prix correct ou d'en annuler la commande. Si Gucci est incapable de contacter le Client, la commande sera considérée annulée.
3.3
Le transfert de la propriété du Produit acheté sur le site au Client intervient au moment de la livraison du Produit, à condition que Gucci ait reçu le paiement intégral du Produit. Dans tous les cas, les risques de perte et d'endommagement du Produit incombent au Client dés lors que le Produit lui a été livré.
4.0 Modalités d’achat
4.1
Les caractéristiques essentielles et le prix des Produits indiqués dans l'offre relative à chacun des Produits sont indiqués sur le Site.
4.2
Pour l'achat des Produits, le Client devra remplir et envoyer à G Commerce le bon de commande sous forme électronique, en suivant les instructions contenues dans le site. Le Client devra mettre le Produit dans le « Panier d'achat » approprié et, après avoir visionné et accepté la somme relative aux frais d'envoi, ainsi que les Conditions Générales, les dispositions relatives à la Politique de confidentialité et les modalités du droit de rétractation, il devra sélectionner le titre de paiement souhaité et choisir l'option « achat ».
4.3
Si le client a besoin de corriger d’éventuelles erreurs d’insertion des données, il devra suivre la procédure de modification adéquate contenue sur le Site avant d’envoyer sa commande. En particulier, le Client a la faculté de modifier la quantité de Produits qu’il souhaite acheter, en ajoutant ou en annulant un ou plusieurs Produits du « Panier d'achat ».
5.0 Conclusion du contrat
5.1
Le Contrat signé entre Gucci et le Client est considéré conclu au moment où la commande passée par le Client – conformément à la procédure d'achat indiquée sur le Site et après obtention de l'autorisation de débit par la société émettrice de la carte de crédit utilisée par le Client pour le paiement - parvient à l'adresse du Site. La commande envoyée par le Client ne sera opposable à Gucci que dans la mesure où l'ensemble de la procédure d'achat a été effectué régulièrement et de manière correcte, sans qu’aucune erreur ait été constatée par le Site. Gucci ne saurait être tenue responsable des dysfonctionnements techinques liés à la connection Internet du Client.
5.2
En passant la commande à Gucci le Client reconnaît et déclare avoir pris connaissance de toutes les indications qui lui ont été fournies pendant la procédure d'achat et accepter intégralement les Conditions Générales.
5.3
Le formulaire sera archivé sur la banque de données du Site pendant la période nécessaire au traitement des commandes.
5.4
Gucci transmettra au Client, par courrier électronique, une confirmation de réception de sa commande contenant les informations relatives à Gucci: un récapitulatif des Produits commandés ainsi que leur prix, la date et l’heure de la commande, les frais de livraison et la modalité de paiement choisie par le Client. Les instructions afin de pouvoir accéder sur le Site aux modalités d’achat, au récapitulatif des Conditions et à la Politique de Protection de la Vie privée seront également indiquées.
Le Client devra vérifier dans les plus brefs délaisle contenu de la communication et signaler immédiatement à Gucci d’éventuelles erreurs ou omissions.
6.0 Modalités de paiement
6.1
Le Client pourra effectuer le paiement des Produits et des frais d’envoi correspondant au moyen d’une carte de crédit. Gucci accepte les paiements effectués au moyen des cartes de crédit suivantes:

La transaction ne sera débitée sur la carte de crédit du Client qu’après vérification des données de celle-ci, réception de l'autorisation de débit de la part de la société émettrice de la carte de crédit utilisée par le Client, confirmation de la disponibilité du Produit par Gucci et donc après que la commande sera prête à être expédiée.
Aucun débit ne sera fait au moment de l'envoi de la commande.
7.0 Transport et livraison
7.1
Pour des raisons de sécurité, les Produits achetés sur le Site seront livrés à l'adresse associée à la carte de crédit et la signature d’un adulte âgé de 18 ans ou plus sera exigée au moment de la livraison.
Il ne sera pas effectué de livraison à des boîtes postales et dans ce cas les commandes ne seront pas traitées.
7.2
Pour chaque commande effectuée sur le Site, Gucci émet une facture des marchandises expédiées qu’elle envoie par courriel ou courrier postal au titulaire de la commande, conformément au D.P.R. 445/2000 et au D. Lgs. 52/2004. Pour l'émission de la facture ce sont les informations fournies par le Client au moment de la commande qui font foi. Aucune modification de la facture ne sera possible après émission de celle-ci.
7.3
Les frais d’envoi sont à la charge du Client et apparaissent distinctement sur le bon de commande. Ils peuvent varier selon les modalités d'expédition choisies et le lieu de destination des Produits.
7.4
Tous les achats seront livrés par courrier UPS Express Saver ou autre courrier (ci-après, «Courrier») expédié le jour ouvrable suivant la confirmation de la disponibilité et de la prise en charge de la commande.
Les commandes seront expédiées du lundi au vendredi, sauf jours fériés et fêtes nationales. Gucci ne saurait être tenue responsable des retards de livraison imprévisibles, sous réserve que, sauf pour les cas de force majeure, les Produits soient livrés dans un délai maximum de 30 (trente) jours à compter du jour suivant la transmission de la commande par le Client.
7.5
La livraison de la marchandise devra se faire en présence du Client ou d’une personne désignée par lui à l'adresse du destinataire indiquée dans la commande. Au moment de la livraison de la marchandise par le Courrier, le Client est tenu de vérifier:
(i) que le nombre de colis livrés correspond aux indications du document de transport (DDT);
(ii) l'emballage est intact, non endommagé, ni mouillé ou quoi qu’il en soit altéré, y compris pour les matériaux utilisés pour la fermeture du colis. Le client devra immédiatement contester les dommages éventuels subis à l'emballage et/ou aux Produits ou une erreur au niveau du nombre de colis ou de la non-conformité des indications, en apposant une réserve de contrôle écrite sur le justificatif de livraison du Courrier. Après signature du document du Courrier, le Client ne pourra opposer aucune contestation sur l’aspect extérieur de la livraison.
7.6
Dans l'hypothèse où Gucci n'est pas en mesure de livrer la marchandise commandée en raison d’une indisponibilité soudaine, voire temporaire, des Produits, le Client en sera informé sans délai et, dans tous les cas, au plus tard dans les 30 (trente) jours par courrier électronique. La somme déjà payée par le Client lui sera remboursée dans les plus brefs délais et dans tous les cas au plus tard dans les 30 jours suivant la réception de la commande.
8.0 Numéro d’expédition
8.1
Après expédition des Produits, Gucci enverra au Client un courriel de confirmation. De plus, Gucci enverra un courriel de confirmation de la livraison dés qu’elle aura connaissance de la livraison effective par le Courrier.
8.2
Afin de garantir la sécurité de la livraison du Produit, Gucci ne fournira pas le numéro d'expédition au Client, mais conservera ce numéro d'expédition pour chaque livraison effectuée.
9.0 Retours, annulation des commandes et droit de rétractation
9.1
Gucci souhaite garantir la satisfaction totale du Client.
Gucci remboursera intégralement les Produits restitués par le Client s'ils n'ont pas été endossés, utilisés et abîmés et s'ils sont accompagnés de leur facture.
Certains articles sont expédiés avec une étiquette de retour/échange, attachée au produit. Les retours et échanges de ces articles spécifiques ne pourront être traités que si l'étiquette, toujours attachée, est intacte et si les instructions de retour ci-dessus sont respectées.
Les remboursements seront effectués selon les mêmes modalités de paiement prévues pour l'achat.
La marchandise achetée pourra être restituée dans les 15 (quinze) jours suivant la date de livraison. Les produits achetés en ligne ne pourront être ni remboursés ni retournés aux magasins Outlets. Les frais d'envoi ne sont pas remboursables.
9.2
Les frais d’envoi relatifs à la restitution des Produits sont à la charge du Client.
9.3
G Commerce se réserve le droit de refuser la restitution des Produits qui ne seraient pas conformes aux conditions visées au paragraphe 9.1.
9.4
Chaque livraison contient des instructions simples relatives au retour des Produits.
Gucci tâchera de rembourser le Client rapidement dans un délai maximum de 30 jours suivant la demande d'annulation écrite ainsi que la réception de la marchandise retournée, selon le paragraphe 9.1.
Gucci enverra un courriel de confirmation après avoir effectué le remboursement.
9.5
Il est recommandé d'expédier les Produits retournés en utilisant un Courrier assuré permettant le suivi de l'expédition.
Gucci ne saurait être responsable de l'indemnisation des produits égarés lors de leur retour, volés ou abîmés.
9.6
Aux termes de l'article 64 du D. Lgs. N° 206/2005, le Client a le droit de résilier le présent contrat sans aucune pénalité et sans en donner la raison dans un délai de 15 (quinze) jours ouvrables suivant la date de réception des Produits, sous réserve des stipulations de l’article 9.7 ci-après.
9.7
Pour exercer son droit de rétractation, le Client devra envoyer à l'adresse suivante:assistance@be-onlineshopping.gucci.com
une communication écrite, avec accusé de réception contenant:
l'énoncé de sa volonté d'utiliser son droit de rétractation conformément à l’article 64 du D. Lgs. 206/2005);
l'indication des Produits pour lesquels le Client souhaite faire usage de son droit de rétractation;
le numéro de commande délivré au moment de l'achat;
La communication peut être expédiée, dans un délai de 15 (quinze) jours ouvrables, comme indiqué ci-dessus, par télégramme, télex et fax, à condition d'être confirmée par lettre recommandée avec accusé de réception dans les 48 (quarante huit) heures qui suivent.
9.8
Si le Client souhaite modifier ou annuler la commande qu'il a présentée, il devra envoyer en temps utile un courriel à l'adresse:

Gucci fera tout son possible pour satisfaire la demande du Client. Toutefois, une fois que le Produit aura été expédié la commande ne pourra pas être annulée ou modifiée tant que la marchandise expédiée n'aura pas été restituée à Gucci. Dans ce cas, il est fait application des stipulations de l’article 9.1.
10.0 Échanges
10.1
L’échange d’un article sur le Site s’effectue en suivant la procédure suivante. Veuilez noter que votre carte de crédit sera d’abord créditée, puis débitée du montant du nouvel article.
Veuillez compléter le formulaire fournit dans votre colis en indiquant la référence et la taille de l’article que vous souhaitez recevoir.
Alternativement, veuillez sélectionner sur notre Site l’article de remplacement et le commander en nous en informant.
Ensuite, veuillez nous retourner l’article d’origine en suivant les directives soulignées dans la section précédente. Veuillez noter que l’article doit être délivré à Gucci dans les mêmes conditions d’origine et que les nouvelles commandes sont sujettes à la disponibilité dont dispose Gucci. Les frais d’envoi pour tout article retourné sont à la charge du Client. Veuillez contacter assistance@be-onlineshopping.gucci.com afin de vous assurer qu’aucun frais d’envoi supplémentaire ne sera inclus dans le prix de l’article de remplacement. Votre article de remplacement vous sera livré via UPS sans coût supplémentaire.

Conformément aux dispositions de l’article 47, §4, 2° de la loi du 6 avril 2010 relative aux pratiques du marché et à la protection du consommateur, le droit de rétractation pour l’annulation ou le retour est exclu pour les commandes de Produits personnalisés, par exemple en gravant les initiales du client sur le Produit. Le client est conscient du fait que la représentation graphique proposée sur le site ne correspond pas nécessairement à la réalité : il est en effet possible que les images et les photographies de la gravure ne reflètent pas le véritable aspect du produit final.
11.0 Emballage cadeau
11.1
Les Produits achetés sur le Site sont livrés dans des boîtes cadeau. Les Produits sont enveloppés dans du papier vélin et emballés dans une boîte cadeau portant le logo Gucci. La boîte est ensuite entourée d’un ruban de satin portant le logo Gucci.
Les boîtes cadeau Gucci sont généralement disponibles pour des produits ayant une dimension de 46x46x20 cm ou plus petits. Pour les objets de dimension supérieure, l'expédition comprendra une enveloppe/boîte cadeau Gucci adéquate.
12.0 Erreurs, inexactitudes
12.1
Gucci actualise constamment les informations publiées sur le Site. Toutefois, il est impossible de garantir que le Site soit dénué de toute erreur. Le Site pourrait contenir des erreurs de saisie, des erreurs, inexactitudes ou omissions, dont certaines pourraient concerner le prix et la disponibilité du Produit et la description du Produit lui-même.
Gucci se réserve le droit de corriger les erreurs, inexactitudes ou omissions y compris après l'envoi d'une commande et se réserve également le droit de changer ou actualiser les informations à tout moment sans préavis.
13.0 Garantie d'authenticité
13.1
Gucci garantit l'authenticité de tous les Produits achetés sur le Site. Les Produits portant la marque Gucci sont fabriqués avec des matériaux et une main d’œuvre d’une qualité exceptionnelle. Tous les Produits sont fabriqués en Italie, à la seule exception des Produits d'horlogerie, réalisés en Suisse.
13.2
Les Produits originaux portant la marque Gucci sont vendus sur Internet exclusivement par le biais du Site www.gucci.com.
Tous les droits de propriété intellectuelle tels que les marques, marques de service, marques de forme et copyright sont la propriété exclusive de Gucci. La reproduction de toute page ou contenu du présent Site est soumise à une autorisation préalable écrite de la part de Gucci.
14.0 Défauts de conformité
14.1
